 1. A non-profit organization can be created through its formation, as well as as a result of the reorganization of an existing non-profit organization.

A non-profit organization in the organizational and legal form of a higher scientific organization or an autonomous educational organization may be established as a result of the transformation of a joint-stock company in cases stipulated by the laws of the Republic of Kazakhstan "On Science and Technological Policy", "On the status of Nazarbayev University, Nazarbayev Intellectual Schools and Nazarbayev Foundation".

A non-profit organization in the organizational and legal form of a non-profit joint-stock company or institution may be created as a result of the transformation of an organization of higher and (or) postgraduate education established as a commercial organization.

A non-profit organization in the organizational and legal form of an autonomous cluster fund may be created as a result of the transformation of a joint-stock company in the case provided for by the Law of the Republic of Kazakhstan "On the Astana Hub Innovation Cluster".

2. The creation of a non-profit organization (with the exception of public and religious associations) through its formation is carried out by decision of the founders (founder).

The establishment of public and religious associations is carried out in accordance with the laws of the Republic of Kazakhstan.

3. The legal capacity of a non-profit organization as a legal entity arises from the moment of its state registration.

The legal capacity of a non-profit organization in the field of activity for which a license is required arises from the moment of obtaining such a license.
