Article 19. Passage of persons, vehicles, goods and goods across the State border. Checkpoints of the Law On the State Border of the Republic of Kazakhstan
1. The passage of persons, vehicles, goods and goods across the State Border is carried out at checkpoints opened in accordance with the legislation of the Republic of Kazakhstan and international treaties ratified by the Republic of Kazakhstan, as well as in other places where passage across the State Border is carried out, determined by the Government of the Republic of Kazakhstan.
2. The rules of opening (closing), operation (operation), categorization, classification, arrangement, as well as requirements for technical equipment and organization of work of checkpoints are determined by the Government of the Republic of Kazakhstan.
3. The list of checkpoints is approved by the Government of the Republic of Kazakhstan.
4. The checkpoints house units of the regulatory authorities responsible, within their competence, for the organization of border, customs, transport, sanitary-quarantine, veterinary, phytosanitary control and control over the movement of specific goods.
4-1. For the organization of military transportation, military personnel of military communications agencies are stationed at checkpoints.
5. When persons are allowed to pass through checkpoints, as well as in other places where they are allowed to cross the State Border, the passport control line acts as the State Border.
5-1. Entry into and exit from the territory of the special economic zone, the limits of which fully or partially coincide with the sections of the customs border of the Eurasian Economic Union, officials of state bodies, employees of the collection service operating in the territory of such a special economic zone, as well as persons visiting such a special economic zone for official purposes, are carried out in accordance with the procedure established by the Legislation of the Republic of Kazakhstan. determined by the National Security Committee of the Republic of Kazakhstan.
The entry and exit of special vehicles of the collection service is carried out by inspection (if necessary) without opening sealed collection bags (bags).
In order to ensure the safety of transported valuable goods, employees of the collection service have the right to use personal protective equipment, store and carry service weapons and ammunition on the territory of the special economic zone, the limits of which fully or partially coincide with the sections of the customs border of the Eurasian Economic Union, in accordance with the legislation of the Republic of Kazakhstan.
6. The passage of persons, vehicles, cargoes and goods across the State Border is carried out by the Border Service of the National Security Committee of the Republic of Kazakhstan.
7. Persons are allowed to cross the State Border if they have documents for the right to enter or leave the Republic of Kazakhstan, as well as if there are no restrictions on these persons established by the laws of the Republic of Kazakhstan.
8. The passage of vehicles, goods and goods across the State Border is carried out in the presence of permits from state revenue authorities and other regulatory authorities for the right to import vehicles, goods and goods into the Republic of Kazakhstan or export from the Republic of Kazakhstan.
8-1. Passage of motor vehicles, cargoes and goods across the State Border, including using the electronic queue system, may be carried out on a fee basis in accordance with the procedure determined by the state body responsible for ensuring tax revenues and other mandatory payments to the budget and the authorized body in the field of customs affairs in coordination with the Border Guard Service. by the Service of the National Security Committee of the Republic of Kazakhstan.
At the same time, non–residents – owners of motor vehicles and users of the electronic queue system - non-residents who have not executed in a timely manner an administrative penalty in the form of a fine and (or) an order on the need to pay a fine in the field of road safety, arrears for travel on toll roads (sections), are not subject to registration in the electronic queue system. queues before such payments and fines are paid.
The organization of the development, implementation and operation of the electronic queue system, as well as measures to collect fees for the passage of motor vehicles, goods and goods across the State Border and for booking an electronic queue is carried out by the state body responsible for ensuring tax revenues and other mandatory payments to the budget., and the authorized body in the field of customs affairs in coordination with the Border Guard Service of the National Security Committee of the Republic of Kazakhstan through the use of a public-private partnership mechanism or other mechanisms in accordance with the legislation of the Republic of Kazakhstan.
It is prohibited to provide other paid services when passing motor vehicles, goods and goods across the State Border using an electronic queue system within the framework of a public-private partnership mechanism.
Unless otherwise provided by legislative acts of the Republic of Kazakhstan, the amount of fees for passage of motor vehicles, goods and goods across the State Border, as well as their passage through an electronic queue, are determined by the state body responsible for ensuring tax revenues and other mandatory payments to the budget, and the authorized body in the field of customs affairs in coordination with the antimonopoly the organ.
9. The State Border crossing is considered completed upon completion of the border control procedure and upon departure of a person, vehicle or export of goods and goods outside the checkpoint, as well as other place where the State Border crossing is carried out.
10. In accordance with the laws of the Republic of Kazakhstan, foreigners and stateless persons who are not allowed or restricted entry into the Republic of Kazakhstan, as well as persons against whom a decision has been taken to prohibit departure from the Republic of Kazakhstan, are not allowed to cross the State border. Foreigners and stateless persons who arrive at a checkpoint or other place where they are allowed to cross the State Border, and who have no grounds for being allowed to cross the State Border, in accordance with international treaties of the Republic of Kazakhstan, return to the country from where they came or to the country of their citizenship.
