1. The occurrence of road accidents and their consequences are possible as a result of the existing risks in the field of traffic associated with the implementation of activities in the following areas:

1) the risk of organizations engaged in cargo and passenger transportation. This includes the risk of putting into operation a mechanical vehicle with technical malfunctions, as well as allowing people to drive vehicles whose health condition does not ensure safe driving.;

2) the risk of managers of highways, railway crossings and other road structures. This includes the risk of maintaining roads, railroad crossings, and other road structures in violation of their operational requirements.;

3) the risk of medical organizations. It includes risk:

providing untimely medical care to victims of a traffic accident;

admission of persons to participate in traffic who have medical contraindications or restrictions to driving vehicles;

4) the risk of educational organizations. This includes the risk of poor-quality training of candidates for drivers of motor vehicles and children in traffic rules as a result of violations of the requirements established by the legislation of the Republic of Kazakhstan.;

5) the risk of design and construction organizations. It includes the risk of designing, constructing, repairing, and reconstructing roads and road infrastructure facilities without taking into account traffic safety requirements.;

6) the risk of organizations performing work and providing services for vehicle maintenance and repair. This includes the risk of carrying out maintenance and repair of vehicles in violation of the norms and rules established by vehicle manufacturers, the requirements of technical regulations on the safety of wheeled vehicles and requirements for emissions of harmful (polluting) substances of vehicles.;

7) the risk of organizations engaged in the design and manufacture of vehicles. It includes risk:

design and manufacture of vehicles without taking into account their safety requirements in traffic conditions;

imperfections in the design, technological processes, or control systems of mass-produced and mass-produced products that do not meet safety requirements for manufactured vehicles and their components.;

8) the risk of conformity assessment bodies and testing laboratories. It includes risk:

confirmation of conformity of vehicles, items of equipment and spare parts installed and (or) used on them in violation of the requirements provided for in the field of technical regulation of vehicle safety;

commission of a traffic accident due to imperfections, absence or technical malfunctions of individual structural elements of a new vehicle;

imperfections in technological processes or control systems for mass-produced and mass-produced products that do not allow meeting safety requirements for new vehicles and their components being put into operation.;

9) the risk of organizations performing technical inspection. It includes risk:

imperfections in technological processes or control systems for vehicle inspection lines that do not allow for the fulfillment of safety requirements for operated vehicles and their components;

improper technical inspection of motor vehicles as a result of violation of the requirements established by the legislation of the Republic of Kazakhstan;

10) the risk of trading organizations. This includes the risk of selling vehicles, equipment and spare parts that can be installed and/or used on vehicles that do not meet the technical safety requirements of vehicles.;

11) the risk of road and vehicle owners. This includes the risk of operating roads and vehicles with conditions that create a high degree of road accidents.

2. The traffic risk management system is established by this Law.

The Law of the Republic of Kazakhstan dated April 17, 2014 No. 194-V SAM.

This Law establishes the legal basis and general conditions for the functioning of road traffic and ensuring its safety in the Republic of Kazakhstan.
