1. Under the asset trust management agreement of a mutual investment fund, the investor transfers money to the trust management of the management company in order to combine it with the money of other investors in the mutual investment fund and subsequently invest it according to the rules of this fund.

2. The trust management agreement for a mutual investment fund is an affiliation agreement, the terms of which are determined by the management company in the rules of the mutual investment fund. The terms of the trust management agreement for a mutual investment fund may be accepted by the holder of the fund's share only by joining the said agreement as a whole.

3. In addition to the conditions stipulated by the legislative acts of the Republic of Kazakhstan, the trust management agreement for a mutual investment fund must contain:

1) conditions and procedure for termination of the agreement and (or) termination of the fund's existence;

2) the terms and procedure for transferring the fund's assets to another management company, and for the management company to fulfill its obligations to terminate the fund's existence, including in cases of suspension or revocation of its investment portfolio management license;

3) the responsibility of the parties.

This Law defines the legal status, specifics of the creation, operation, reorganization and liquidation of a joint-stock investment fund, the conditions and procedure for the creation, operation and termination of a mutual investment fund, the specifics of the legal status and activities of venture funds in the Republic of Kazakhstan, regulates relations related to the activities of professional securities market participants to ensure the functioning of investment funds, and It also defines the procedure for state regulation of investment funds.
