Article 20-2. Observers of foreign states and international organizations, representatives of foreign mass media of the Constitutional Law on Elections in the Republic of Kazakhstan
1. Invitations to foreign states and international organizations to participate in election observation in the Republic of Kazakhstan may be sent by the Chairman of the Central Election Commission, the Minister of Foreign Affairs of the Republic of Kazakhstan.
Invitations are sent through the Ministry of Foreign Affairs of the Republic of Kazakhstan.
The invitation may contain suggestions for the size and composition of the mission, as well as for ensuring gender balance and country representation in the mission.
2. Observers of foreign states and international organizations are accredited at the Central Election Commission on the recommendation of the Ministry of Foreign Affairs of the Republic of Kazakhstan.
For accreditation, foreign States and international organizations submit a list of their observers and representatives to the Ministry of Foreign Affairs of the Republic of Kazakhstan.
Individuals who are not observers of foreign States and international organizations are not subject to accreditation.
Persons who have political, economic or other interests in the Republic of Kazakhstan or whose accreditation was previously revoked (cancelled) for violating the legislation of the Republic of Kazakhstan, a foreign state or generally recognized norms of international law, or who were found guilty of committing a criminal offense, corruption offense or illegal activities during the electoral period five years before applying for accreditation.
3. The term of accreditation of observers of foreign states and international organizations shall be established by the Central Election Commission.
4. Accredited observers of foreign states and international organizations are issued a certificate of the standard established by the Central Election Commission, which is the basis for their activities during the election campaign. The accreditation period ends at eighteen o'clock local time, five days before the voting day.
5. Observers of foreign states and international organizations, representatives of foreign mass media are not entitled to use their status to carry out activities not related to election observation in the Republic of Kazakhstan.
6. Observers of foreign states and international organizations, representatives of foreign mass media have the right to:
1) be present at all stages of the electoral process;
2) to receive information about the course of the election campaign from the election commissions;
3) access to polling stations during voting and vote counting;
4) to meet with the participants of the electoral process;
5) inform members of election commissions about their observations, identified violations, and make recommendations;
6) make public statements;
7) observe the procedure for transmitting protocols on voting results to higher election commissions.
7. Observers of foreign states and international organizations, representatives of foreign mass media are obliged to:
1) have their identity and accreditation documents with them.;
2) not to interfere in the electoral process, in the procedure of vote counting and decision-making by the election commission;
3) not to take actions that impede the work of the election commission;
4) comply with the requirements of the chairman of the election commission to comply with the rules of conduct at the polling station established by the relevant election commission;
5) to keep an open mind, not to express preference for a particular candidate or political party;
6) comply with the requirements of this Constitutional Law and other legislation of the Republic of Kazakhstan.
8. In cases stipulated by this Constitutional Law, the Central Election Commission has the right to revoke the accreditation of an observer of a foreign state or an international organization.
9. In case of violation by observers of the legislation of the Republic of Kazakhstan or generally recognized norms of international law, the relevant election commission has the right to submit to the Central Election Commission a submission on revocation of the accreditation of an observer of a foreign state or international organization.
The accreditation of an observer of a foreign State or an international organization may be revoked by the Central Election Commission on the basis of an application from the relevant foreign State or international organization on the recommendation of the Ministry of Foreign Affairs of the Republic of Kazakhstan.
