Article 20. Approval of the tariff in accordance with the simplified procedure of the Law on Natural Monopolies
1. The authorized body approves the tariff in a simplified manner for the regulated service:
1) a natural monopoly entity created for the first time;
2) a natural monopoly entity providing a new regulated service (new regulated services);
3) in case of acquisition (construction) of new facilities and (or) land plots, if the current tariff is approved separately for facilities and (or) land plots;
3-1) in the case of the acquisition (construction) of new sections of access roads that are not an integral part of the access roads for which the subject has approved a tariff;
4) a subject of a low-power natural monopoly.
2. The term of consideration of the application is not more than thirty calendar days from the date of its submission.
3. The validity period of the tariff approved in a simplified manner for natural monopoly entities specified in subitems 1), 2) and 3) of paragraph 1 of this Article should not exceed twelve months.
4. The tariff approved in a simplified manner is put into effect on the first day of the month following the month of tariff approval.
5. Upon expiration of the tariff approved in a simplified manner for the subjects of natural monopolies specified in paragraph 1 of this article, the tariff is approved for one calendar year using the cost method of tariff regulation.
In the event of an overestimation of the tariff approved in a simplified manner for subjects of natural monopolies specified in subitems 1), 2) and 3) of paragraph 1 of this Article, the authorized body is obliged simultaneously with the introduction of new tariffs to make a decision on compensation to consumers of unjustifiably received income by subjects of natural monopolies.
6. The subjects of natural monopolies specified in paragraph 1 of this Article, no later than five calendar days before the tariff comes into effect, inform consumers about it with information containing the reasons for the tariff change and the approved tariff estimate.
7. A natural monopoly entity, whose assets have become its property as a result of a concluded transaction or sale of the estate of a debtor - a natural monopoly entity declared bankrupt, continues to provide regulated services to consumers at the tariff approved for the previous owner of these assets until the approval of the new tariff, but not more than six months from the date of receipt of assets.
8. The authorized body shall hold public hearings on the approval of the tariff in a simplified manner no later than ten calendar days prior to its approval.
