Article 20. Governing bodies of the Chamber of Appraisers The Law on Valuation Activities in the Republic of Kazakhstan

      1. The governing bodies of the Chamber of Appraisers are:  

      1) general meeting of the members of the Chamber of Appraisers;  

      2) the collegial governing body of the Chamber of Appraisers;  

     3) the executive body of the Chamber of Appraisers;

     4) the control body (the audit commission) of the Chamber of Appraisers.

     The procedure for the formation, structure, competence and term of office of the governing bodies of the Chamber of Appraisers, the procedure for making decisions by these bodies are established by the charter of the Chamber of Appraisers in accordance with this Law and other laws of the Republic of Kazakhstan.

      2. The General Meeting of the members of the Chamber of Appraisers is the highest governing body authorized to consider the issues of the Chamber of Appraisers' activities attributed to its competence by this Law, other laws of the Republic of Kazakhstan and its charter.  

      The exclusive competence of the general meeting of the members of the Chamber of Appraisers includes:  

     1) adoption of the charter of the Chamber of Appraisers, amendments and additions to it;

     2) determination of the main activities of the Chamber of Appraisers;

      3) approval of the budget of the Chamber of Appraisers;  

      4) making decisions on the voluntary liquidation of the Chamber of Appraisers and the appointment of a liquidation commission;  

     5) election of members of the collegial management body, the head of the executive body and members of the supervisory body (audit commission) of the Chamber of Appraisers, early termination of the powers of these bodies or the head or their individual members;

     6) approval of reports of the collegial and executive bodies, the control body (audit commission) and specialized bodies in the manner and within the time limits established by the charter of the Chamber of Appraisers;

     7) approval of the regulations on membership in the Chamber of Appraisers;

     8) consideration of the issue of revocation of certificates of qualification "appraiser", "expert"; - Excluded by the Law of the Republic of Kazakhstan dated July 17, 2025 No. 213-VIII SAM 

     9) establishment of the amount of entrance and annual membership fees.

     The amount of annual membership fees must be at least 25 times and not more than 75 times the monthly calculation index established by the law on the republican budget for the relevant fiscal year.

      The amount of the entrance fee should not exceed the amount of the annual membership fees.;  

     10) determination of ways to ensure property liability.

      The procedure for holding a general meeting of members of the Chamber of Appraisers, the procedure for forming the agenda of meetings, determining the quorum, and the conditions and procedure for voting are determined by the charter of the Chamber of Appraisers.  

     The Charter of the Chamber of Appraisers may provide for other issues, the decision-making on which falls within the exclusive competence of the general meeting of the members of the Chamber of Appraisers.

      3. The management of the Chamber of Appraisers is carried out by the collegial governing body of the Chamber of Appraisers, elected by the general meeting of the members of the Chamber of Appraisers.  

      The quantitative composition of the collegial governing body of the Chamber of Appraisers, the procedure and conditions for its formation and operation, decision-making, and termination of powers are established by the charter of the Chamber of Appraisers.  

      4. The competence of the collegial governing body of the Chamber of Appraisers includes:  

     1) approval of the rules and standards of the Chamber of Appraisers, amendments and (or) additions to them;

      2) submitting issues for consideration by the general meeting of the members of the Chamber of Appraisers;  

     3) making a decision on joining the Chamber of Appraisers, suspension and termination of membership in the Chamber of Appraisers;

     4) creation of specialized bodies of the Chamber of Appraisers, approval of their regulations and rules for their activities;

4-1) consideration of the issue of revocation of certificates of qualification "appraiser", "expert";

     5) other issues stipulated by this Law, other laws of the Republic of Kazakhstan and the charter of the Chamber of Appraisers.

     In the Chamber of Appraisers, the functions of a collegial governing body may be performed by a general meeting of the members of the Chamber of Appraisers.

     5. The Executive Body of the Chamber of Appraisers:

      1) organizes the work of the Chamber of appraisers, monitors the fulfillment of the tasks assigned to the Chamber of appraisers;  

     2) carries out the admission and dismissal of employees of the Chamber of Appraisers;

     3) represents the interests of the Chamber of Appraisers in government agencies, public associations, and other organizations;

      4) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan and the charter of the Chamber of Appraisers.  

      6. The control body (the audit commission) is a body of the Chamber of Appraisers that monitors the financial and economic activities of the governing bodies of the Chamber of Appraisers and their officials.  

      The control body (audit commission) of the Chamber of Appraisers is accountable and controlled by the general meeting of the members of the Chamber of Appraisers.  

     The procedure and deadlines for submitting reports to the control body (audit commission) are determined by the charter of the Chamber of Appraisers.

 

     This Law regulates public relations related to the implementation of valuation activities in the Republic of Kazakhstan, and also defines the legal basis for regulating valuation activities.
