Article 20. Post-accreditation agreement of the Law on Accreditation in the field of Conformity Assessment

Article 20. Post-accreditation agreement of the Law on Accreditation in the field of Conformity Assessment

      1. A post-accreditation agreement is concluded between the accreditation body and the subject of accreditation.  

      2. The essential terms of the post-credit agreement are:  

      1) the subject of the contract;  

      2) the rights and obligations of the parties;  

      3) the cost of the work;  

     4) the procedure and timing of scheduled and unscheduled assessments, renewal of the accreditation certificate, updating of accreditation materials;

      5) the procedure for conducting comparative tests and (or) comparisons of the results of verification and calibration of measuring instruments;  

      6) the responsibility of the parties.  

      3. The standard post-credit agreement is approved by the authorized body.  

      4. The post-credit agreement is terminated in the following cases::  

      1) liquidation of a legal entity;  

      2) expiration of the validity period of the accreditation certificate;  

      3) deprivation of the accreditation certificate;  

      4) cancellation of the accreditation certificate;  

      5) excluded by the Law of the Republic of Kazakhstan dated 07/10/2012 No. 31-V (effective after ten calendar days after its first official publication);  

      6) failure to eliminate inconsistencies that served as the basis for revocation of the accreditation certificate;  

      7) termination of the contract in accordance with the civil legislation of the Republic of Kazakhstan.  

     5. The date of termination of the post-credit agreement on the grounds provided for in subparagraph 6) of paragraph 4 of this Article is considered to be the day following the expiration date for the elimination of inconsistencies.

 

 

The Law of the Republic of Kazakhstan dated July 5, 2008 No. 61-IV.

     This Law regulates public relations in the field of accreditation of conformity assessment bodies, as well as related relations.
