1. State control and supervision over compliance with requirements in the field of biological safety (hereinafter referred to as state control and supervision) are aimed at preventing, detecting, suppressing and eliminating their violations and are carried out in accordance with the Business Code of the Republic of Kazakhstan, taking into account the specifics provided for by this Law, the legislation of the Republic of Kazakhstan in the field of sanitary and epidemiological welfare of the population, in the field of veterinary medicine, plant protection, plant quarantine, and counter-terrorism.

2. Subjects or objects of state control and supervision are legal entities that handle pathogenic biological agents, or facilities where pathogenic biological agents are handled (hereinafter referred to as subjects (objects) of control and supervision).

3. Objects of state control and supervision where pathogenic biological agents are handled are classified as objects of high epidemic, epizootic, and epiphytotic risk.

Objects of high epidemic, epizootic, and epiphytotic risk are divided into two groups:

1) potentially dangerous biological facilities where pathogenic biological agents of pathogenicity groups I and (or) II are handled;

2) potentially dangerous biological facilities where pathogenic biological agents of pathogenicity groups III and (or) IV are handled.

The assignment of objects of state control and supervision to these groups is carried out on the basis of criteria for classifying pathogenic biological agents as causing particularly dangerous infectious diseases and a list of pathogenic biological agents, taking into account the classification of pathogenic biological agents by pathogenicity and degree of danger.

4. In relation to subjects (objects) of control and supervision, state control is carried out in the forms provided for by the Business Code of the Republic of Kazakhstan.

5. Within the framework of state control and supervision, rapid response measures may be applied to subjects (objects) of control and supervision in accordance with the Business Code of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated May 21, 2022 No. 122-VII SAM.

This Law defines the legal basis of state regulation in the field of biological safety of the Republic of Kazakhstan and is aimed at preventing biological threats.
