Article 20. The content of technical regulations The Law on Technical Regulation
1. Technical regulations, taking into account the degree of risk of harm, establish the minimum necessary requirements to ensure the safety of products and processes related to the requirements for these products.
2. The technical regulations must contain:
1) an exhaustive list of products and processes that are subject to its requirements;
2) requirements for product characteristics and processes that ensure the achievement of the objectives of the adoption of technical regulations.
The technical regulations may contain rules for sampling and testing products, forms and schemes of conformity assessment and (or) requirements for terminology, packaging, labeling or labeling and rules for their application.
3. Technical regulations should not contain requirements for the design and execution of products, except in cases where, due to the lack of requirements for design and execution, taking into account the degree of risk of harm, the achievement of the goals provided for in paragraph 1 of Article 4 of this Law is not ensured.
4. International, regional and foreign standards may be used as a basis for the development of technical regulations, in whole or in part, if they meet the objectives provided for in paragraph 1 of Article 4 of this Law.
5. If it is impossible to determine the requirements for products whose prolonged use may cause harm, the damage of which depends on factors that do not allow determining the degree of acceptable risk, the technical regulations should contain requirements regarding informing the consumer about the possible harm to the product and the factors on which it depends.
6. Technical regulations may contain special requirements, taking into account the degree of risk of harm.:
1) ensuring the protection of certain categories of citizens (minors, pregnant women, nursing mothers, persons with disabilities);
2) applied in certain administrative-territorial units of the Republic of Kazakhstan, if the absence of such requirements due to climatic and geographical features will lead to the failure to achieve the goals provided for in paragraph 1 of Article 4 of this Law.;
3) to transboundary hazardous production facilities that, in the event of man-made emergencies, pose a threat to human life and health, the environment of the Republic of Kazakhstan and other neighboring States.
7. The technical regulations establish requirements that ensure the safety of products and processes.
8. Amendments and additions to the technical regulations containing requirements for product safety and related life cycle processes below those established in the adopted technical regulations are not allowed.
This Law establishes the fundamental principles of technical regulation that arise when establishing and fulfilling requirements for products, related processes, and the provision of services, and also defines the legal basis for the functioning of the state system of technical regulation.
