Article 20. The procedure and terms for classifying information and its carriers of the Law on State Secrets
1. The basis for classifying information obtained (developed) as a result of managerial, industrial, scientific and other types of activities of government agencies, organizations and citizens is their compliance with the lists of information subject to secrecy in force in government agencies and organizations. When classifying this information, their carriers are assigned the appropriate security classification.
2. If it is impossible to identify the information received (developed) with the information contained in the current lists, officials of state bodies and organizations, citizens are obliged to ensure the preliminary classification of the information received (developed) in accordance with the assumed degree of secrecy and, within one month, send proposals for its addition (amendment) to the official who approved the relevant list.
The officials who approved the list are obliged to organize an expert assessment of the received proposals within three months and make a decision on supplementing (changing) the current list or removing the previously classified information. The procedure for classifying information and its media is determined by the Government of the Republic of Kazakhstan.
3. The period of secrecy of information constituting state secrets should not exceed thirty years. In exceptional cases, this period is extended by the conclusion of the authorized state body for the protection of state secrets of the Republic of Kazakhstan.

This Law defines the legal framework and a unified system for the protection of state secrets in the interests of ensuring the national security of the Republic of Kazakhstan, regulates public relations arising in connection with the classification of information as state secrets, their classification, disposal, protection and declassification.
