Article 208. Guarantees provided to the donor, rights and obligations of employers and organizations for the development of blood donation and its components Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan
1. During medical examination and donation of blood and (or) its components, an employee is released from work on working days while maintaining the average salary.
2. A donor who has donated blood and (or) its components free of charge is provided with an additional day of rest with an average salary, which can be added to the annual work leave. These guarantees are valid for one year from the date of donation.
In case of failed donation of blood and its components, an additional day of rest is not provided.
3. If, by agreement with the employer, an employee who is a donor has started work on the days of blood donation and (or) its components, he is provided with another day of rest at his request, while maintaining his average salary, or this day can be added to the annual work leave.
4. It is not allowed to involve an employee who is a donor in night work, overtime work, heavy work, work with harmful and (or) dangerous working conditions on the days of blood donation and (or) its components.
5. Military personnel, employees of law enforcement and special government agencies, civil protection agencies, as well as students who are donors, on days of blood donation and (or) its components, are exempt from duty, shifts and other forms of service and from the educational process.
6. Donors are encouraged in accordance with the legislation of the Republic of Kazakhstan.
7. A donor who has donated blood and (or) its components free of charge, in order to replenish the volume of his blood and energy expenditure of the body after donating blood and (or) its components, optionally receives free food or its monetary equivalent in the amount established by the authorized body.
In case of a failed donation of blood and (or) its components, free food or its monetary equivalent is not provided to replenish the volume of one's blood and energy expenditure of the body after donation of blood and (or) its components.
8. A payment is made to a donor of blood and its components who performs donation of blood and its components on a reimbursable basis by a healthcare organization engaged in the field of procurement of blood and its components.
9. The procedure, criteria and amount of payments to donors who donate blood and its components on a reimbursable basis shall be established by the authorized body.
10. Employers and heads of organizations, in order to create conditions that ensure the development of donation, are obliged to:
1) to assist local public health authorities and public health organizations in attracting citizens of the Republic of Kazakhstan to the ranks of donors;
2) provide the necessary facilities free of charge and create conditions for the collection of blood and its components;
3) freely release an employee who is a donor from work on the day of examination and donation of blood and its components;
4) provide the employee who is a donor with the guarantees established by this Code.
11. Employers and heads of organizations have the right to additionally encourage donors.
