Article 21. Ensuring political security of the Law on National Security of the Republic of Kazakhstan

Article 21. Ensuring political security of the Law on National Security of the Republic of Kazakhstan

     1. Political security is ensured by decisions and actions of state bodies, organizations, officials and citizens aimed at:

     1) protection of the foundations of the constitutional order, state sovereignty and territorial integrity from unlawful encroachments;

     2) preservation of independence of the Republic of Kazakhstan in political decision-making;

     3) improvement of the activities of state bodies and the order of public administration;

     4) ensuring the security of state institutions;

     5) raising the level of the political culture of the society.

     2. Appeals of citizens, including representatives of political parties and other public associations, to:

     1) overthrow or violent change of the constitutional order, including calls for terrorism, extremism, separatism and other actions encroaching on the unitary structure of the Republic of Kazakhstan, the integrity, inviolability and inalienable rights of its territory;

     2) the seizure of power;

     3) forcible termination of powers or obstruction of the activities of bodies and officials of the Republic of Kazakhstan formed or elected (appointed) in accordance with the Constitution and legislation of the Republic of Kazakhstan;

     4) the use of existing confessional differences and different religious beliefs for political, extremist and terrorist purposes.

     3. Ensuring the security of state institutions is the responsibility of the heads of state bodies of the Republic of Kazakhstan and is considered one of the criteria for evaluating their professional activities.

     Civil servants of the Republic of Kazakhstan are obliged to be guided by national interests in their activities. Civil servants are prohibited from making decisions and actions that could cast doubt on the authority of State power, leading to the use of their official position in off-duty interests.

     4. The State shall take measures aimed at:

     1) increasing the authority and prestige of the civil service;

     2) the formation of organizational and legal mechanisms that prevent the entry into public service of persons who do not meet the established requirements.

     5. It is not allowed to make decisions and commit actions contrary to the interests of formation and uninterrupted functioning.:

     1) the unified system of state bodies of the Republic of Kazakhstan;

     2) the unified legal system of the Republic of Kazakhstan.

     6. Foreigners and stateless persons carrying out subversive activities against the Republic of Kazakhstan, publicly speaking out against the sovereignty, territorial integrity of Kazakhstan, unity of its people, social harmony and political stability in the country are not allowed to enter the Republic of Kazakhstan, as well as if there is information about their involvement in extremism or terrorist activities or in if the court recognizes a dangerous recidivism in their actions. Foreigners and stateless persons residing in the territory of the Republic of Kazakhstan and allowing such public appearances are subject to expulsion from the country and bear other responsibilities in accordance with the laws and international treaties of the Republic of Kazakhstan.

 

 

The Law of the Republic of Kazakhstan dated January 6, 2012 No. 527-IV.

     This Law regulates legal relations in the field of national security of the Republic of Kazakhstan and defines the content and principles of ensuring the security of man and citizen, society and the state, the system, goals and directions of ensuring national security of the Republic of Kazakhstan.
