Article 21. Requirements for the protection of the fertile soil layer The Law of the Republic of Kazakhstan On Soil Protection   

      1. The removal of the fertile soil layer shall be permitted exclusively in cases where such removal is necessary to prevent the irretrievable loss of the fertile soil layer.

      2. Persons whose activities lead to soil disturbance shall be obliged to ensure the timely removal of the fertile soil layer and its storage in conditions that exclude the deterioration of its quality.

      3. The removed fertile soil layer shall be used only for the reclamation of disturbed lands, improvement of the quality of agricultural land and low-productivity lands, restoration of degraded soil, as well as for landscaping and improvement of populated areas, provided it complies with hygienic standards.

      4. The export of the removed fertile soil layer outside the Republic of Kazakhstan shall be prohibited.

This Law regulates public relations in the field of soil protection and defines their legal, economic and organizational bases.
