1. The selection of biological material for genomic registration is carried out:

1) for convicted persons subject to genomic registration – by the internal affairs bodies;

2) from unidentified persons whose biological material was seized during a pre-trial investigation in accordance with the procedure established by the Criminal procedure law of the Republic of Kazakhstan – by the bodies of inquiry, investigation, conducting criminal proceedings, with the involvement of specialists from the authorized division of internal affairs bodies and (or) forensic medicine and compliance with the requirements of the Criminal Procedure Code of the Republic of Kazakhstan;

3) the biological relatives of missing citizens – by the internal affairs bodies;

4) from unidentified corpses – by the internal affairs bodies with the involvement of a specialist doctor in the field of forensic medicine.

2. The selection of biological material from the biological relatives of missing citizens for genomic registration is carried out on the basis of their written application.

The selection of biological material from a minor who is a biological relative of a missing person is carried out with his consent in the presence and on the basis of a written application from his legal representative.

The selection of biological material from a person who has been declared legally incompetent by a court decision and is a biological relative of the missing person is carried out in the presence and on the basis of a written application from his guardian.

3. In the case of poor-quality initial selection of biological material, which excludes the receipt of genomic information, the biological material of convicted persons subject to genomic registration, biological relatives of missing citizens, is re-selected at the request of the authorized department of internal affairs bodies carrying out genomic registration.

4. The biological material selected for genomic registration is used to obtain genomic information.

5. Biological material for genomic registration is not selected upon conviction of a person who has passed it earlier.

This Law regulates public relations in the field of fingerprint and genomic registration in the Republic of Kazakhstan.
