1. The Presidium of the National Chamber (hereinafter referred to as the Presidium) consists of an odd number of its members and is headed by the Chairman.

The Presidium is formed from:

1) excluded by the Law of the Republic of Kazakhstan dated 13.06.2018 No. 160-VI (effective from 22.07.2018);

2) at least 5 deputies of the Parliament of the Republic of Kazakhstan, public figures of the Republic of Kazakhstan and (or) representatives of republican associations (unions) representing the interests of small and medium-sized businesses;

2-1) The Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan;

3) Chairmen of the committees of the Presidium;

4) Chairmen of regional councils.

2. In order to form the presidium, the members of the Presidium are elected and dismissed by the decision of the congress.:

1) Chairman of the Presidium from among the members of the Presidium;

2) public figures of the Republic of Kazakhstan and (or) representatives of republican associations (unions) representing the interests of small and medium-sized businesses;

3) deputies of the Parliament of the Republic of Kazakhstan;

4) excluded by the Law of the Republic of Kazakhstan dated 05/21/2024 No. 86-VIII (effective sixty calendar days after the date of its first official publication). 3. Excluded by the Law of the Republic of Kazakhstan dated 13.06.2018 No. 160-VI (effective from 22.07.2018).

4. The exclusive competence of the Presidium includes:

1) monitoring the progress of the tasks and achievement of the goals of the National Chamber;

2) making proposals to the Congress on improving the effectiveness of the National Chamber;

3) election of the Chairman and members of the Board of the National Chamber;

4) assistance to the Board of the National Chamber in cooperation with state authorities, non-governmental, public, international and other organizations;

5) appointment of audits by the Audit Commission of the National Chamber and approval of reports on their results;

6) approval of rules, regulations and other internal documents applied in the activities of the National Chamber, unless otherwise provided by this Law;

7) approval of the qualification requirements for the accreditation of associations (unions) in the National Chamber system and the rules for the accreditation of associations (unions) in the National Chamber system;

8) the appointment of the first heads of legal entities with the participation of the National Chamber as a founder upon the recommendation of the Board of the National Chamber, with the exception of the appointment of the directorates of the regional chambers;

9) formation of committees of the Presidium, determination of their quantitative and personal composition, approval of the rules of their work;

10) approval of the model charter of the regional Chambers and the model regulations on the branches of the regional chambers;

11) approval of the procedure for maintaining the independent Business Climate rating, public monitoring, preparation and publication of the annual national report on the state of entrepreneurial activity in the Republic of Kazakhstan;

12) excluded by the Law of the Republic of Kazakhstan dated 29.10.2015 No. 376-V (effective from 01.01.2016); - Excluded by the Law of the Republic of Kazakhstan.

13) approval of the rules for the formation and maintenance of the register of domestic producers of goods, works and services, as well as the issuance of an industrial certificate. - Excluded by the Law of the Republic of Kazakhstan.

14) making decisions on the establishment and closure of regional chambers;

15) approval of the quantitative composition of regional councils, taking into account the total number of business entities and associations (unions) registered (registered) in the territory of the relevant region, the city of republican significance and the capital;

16) approval of the procedure and timing of the election of delegates to regional councils and the procedure for the formation of regional councils.

5. The Statute of the National Chamber may assign other issues to the competence of the Presidium.

6. Members of the Presidium have the right to request information related to the implementation of their activities from the governing bodies of the National Chamber and legal entities with the participation of the National Chamber as a founder.

7. The Presidium is authorized to make decisions if there is a simple majority of the total number of members of the Presidium at the meeting.

The procedure for voting at the meetings of the Presidium is determined by the statute of the National Chamber.

Decisions on matters of the exclusive competence of the Presidium provided for by this Law shall be taken by a qualified majority of votes amounting to at least two thirds of the total number of votes of the members present at the meeting of the Presidium.

Decisions on other issues are made by a simple majority of the votes of the members present at the meeting of the Presidium.

The transfer of voting rights, as well as voting for other persons, is not allowed.

This Law regulates public relations arising in connection with the establishment and operation of the National Chamber of Entrepreneurs of the Republic of Kazakhstan and the development of entrepreneurship in the Republic of Kazakhstan.
