Article 22. Development and approval of national standards of the Law on Standardization

1. The development of national standards is carried out in accordance with the national standardization plan and/or on an initiative basis.

2. National standards are developed taking into account:

1) the results of scientific research (tests) and measurements;

2) international, regional standards, standards of organizations, standards of foreign states and other documents that establish requirements for the object of standardization;

3) acquired practical experience in the application of new types of products, processes and services.

The period of development of national standards based on scientific research and measurements should not exceed three years.

3. The development of national standards is carried out by the stakeholders of the national standardization system.

The development of fundamental national standards, national and interstate standards included in the lists of standards for technical regulations as interrelated, financed from budgetary funds, is carried out by the national standardization body.

4. Notifications on the beginning and completion of the development of national standards, as well as drafts of national standards, are posted on the Internet resource of the national standardization body.

Public discussion of draft national standards on the Internet resource of the national standardization body is carried out within sixty calendar days.

5. Before approving a national standard, the developer submits its draft to the national standardization body for examination.

A prerequisite for the approval of national standards in accordance with the procedure determined by the authorized body is the achievement of consensus, with the exception of national standards concerning the safety of standardization facilities.

The decision on the approval of national standards concerning the safety of standardization facilities is made by the authorized body in coordination with the interested state body.

6. During the period of public discussion, draft national standards are subject to mandatory technical discussion in the relevant technical committee for standardization, and in the case of its absence – in the national standardization body.

7. The provisions of paragraphs 1, 3, 4, 5 and 6 of this article shall not apply to the development of military national standards.

This Law defines the legal framework for the functioning of the national standardization system.
