Article 22. Ministry of the Republic of the Constitutional Law On the Government of the Republic of Kazakhstan
1. The Ministry is the central executive body of the Republic responsible for the management of the relevant branch (sphere) of public administration, as well as, within the limits provided for by law, inter–sectoral coordination.
The Ministry performs strategic, regulatory, implementation, and supervisory functions within its competence.
The Ministry, based on and in pursuance of the main directions of the internal and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense, security, and public order, developed by the Government of the Republic of Kazakhstan, forms state policy in the relevant sectors in accordance with the current legislation of the Republic of Kazakhstan.
2. The Ministry is formed, reorganized and abolished by the President of the Republic on the proposal of the Prime Minister of the Republic.
2-1. The Ministry is authorized, within the limits of its competence, to independently make decisions on issues not falling within the competence of the Government of the Republic.
2-2. The structural divisions of the Ministry are departments, departments and administrations.
For law enforcement agencies that are part of the Government, taking into account the special type of public service, the creation of services is allowed.
The structure of the Ministry and the regulations on its structural units are approved by the Minister.
The set of services, departments and departments of the Ministry is its apparatus.
3. The Board of the Ministry is an advisory body under the Minister. The numerical and personal composition of the board is approved by the Minister from among the heads of the structural divisions of the Ministry.
4. Decisions taken by the Ministry are formalized by orders of the Minister.
Constitutional Law of the Republic of Kazakhstan dated December 18, 1995 No. 2688.
This Constitutional Law, in accordance with the Constitution of the Republic of Kazakhstan, defines the competence, organization and activities of the Government of the Republic of Kazakhstan.
