Article 23. Updating of accreditation materials of the Law on Accreditation in the field of conformity assessment
1. The accreditation materials shall be updated in the absence of the grounds provided for in paragraph 1 of Article 22 of this Law, in the following cases::
1) making amendments and (or) additions to the regulatory document specified in the documents of the accreditation entity, and (or) putting into effect a new regulatory document;
2) changes in the composition of specialists involved in conformity assessment;
3) replacement of measuring instruments and test equipment.
2. Upon updating, the subject of accreditation submits to the accreditation body an application explaining the reasons for updating and the documents to which changes have been made, in electronic form through the information system of technical regulation or on paper. When submitting an application for updating on paper, the documents to which the changes have been made must be submitted in two copies.
3. The accreditation body reviews the documents within no more than ten working days from the date of their receipt.
In the event of a positive decision and in the absence of grounds for reissuing the accreditation certificate, the accreditation body takes note of the changes made, if necessary, re-approves the document defining the scope of accreditation, which it notifies the subject of accreditation in writing by mail or fax, and it is considered received, respectively, from the date of the applicant's mark in the notification of receipt of the mail or on the day of sending a fax message.
4. The decision to refuse to update the accreditation materials is taken by the accreditation body if false information and (or) information related to the expansion of the scope of accreditation is identified in the submitted documents and information.
The notification of the decision is sent to the subject of accreditation in writing within three working days from the date of the decision by mail or fax and is considered received, respectively, from the date of the applicant's mark in the notification of receipt of the mail or on the day of sending the fax message.
