Article 24. Lists of voters (electors) and the procedure for their compilation of the Constitutional Law on Elections in the Republic of Kazakhstan
1. Voter lists are compiled during the elections of the President, deputies of the Mazhilis of Parliament and maslikhats, akims, and members of other local self-government bodies. Lists of electors are drawn up during the election of deputies to the Senate.
2. Excluded by the Constitutional Law of the Republic of Kazakhstan dated 04/14/2004 No. 545.
3. The basis for including a citizen in the list of voters at a particular polling station is the fact of his registration at his place of residence on the territory of this polling station.
4. The voter lists are compiled in alphabetical or other order. The list shall include the surname, first name, patronymic, year of birth (at the age of eighteen, the day and month in addition), the individual identification number and the address of the voter's place of residence. The lists of electors are compiled in alphabetical or other order and include the surname, first name, patronymic, year of birth, individual identification number, name of the maslikhat of which the elector is a deputy, and the address of his place of residence.
5. The list of voters at the place of residence is compiled by the relevant local executive body on the basis of the state database on individuals.
Every voter has the right to register as a voter with the relevant local executive body from the moment the elections are announced or called.
If a voter becomes aware no later than thirty days before the election that he/she will not be able to arrive at the polling station at his/her place of registration on election day, he/she has the right to apply to the local executive body at his/her place of residence with a written application for inclusion in the relevant voter list.
When a citizen applies in accordance with this paragraph, the local executive body shall arrange for the exclusion of the citizen from the list of voters at the place of registration and his inclusion in the list of voters of the polling station where the citizen will vote.
The voter lists for each polling station are signed by the akim, by whose decision the precinct was formed, and submitted according to the act twenty days before the start of voting.
By July 1 and January 1 of each year, information about voters and the boundaries of polling stations is submitted electronically by the local executive body to the relevant territorial election commissions, which ensure the reconciliation and transmission of information to higher election commissions.
The procedure for reconciliation and submission of information is determined by the Central Election Commission.
Officials of local executive bodies are responsible for the accuracy of the voter lists, as well as data on voters provided by the relevant election commission.
6. Students enrolled in specialized secondary and higher educational institutions, as well as full-time professional postgraduate education programs, who live in dormitories, are included in the voter list at the location of the dormitory.
7. The lists of military personnel who are in military units, as well as their family members and other voters residing in the locations of military units, are compiled on the basis of information provided by the commanders of military units.
8. Voter lists by polling stations established in rest homes, sanatoriums, inpatient medical and preventive institutions, in places where citizens are located in remote and hard-to-reach areas, at cattle breeding sites, in pre-trial detention facilities and temporary detention facilities, as well as at representative offices of the Republic of Kazakhstan in foreign countries, on ships belonging to the Republic of Kazakhstan and those who are sailing on election day, are compiled on the basis of data provided by the heads of these institutions, the relevant akims, heads of these representative offices and ship captains.
Voter lists by polling stations established in places of temporary stay (in rest homes, sanatoriums, inpatient medical and preventive institutions, at cattle breeding sites, in pre-trial detention facilities and temporary detention facilities, as well as at representative offices of the Republic of Kazakhstan in foreign countries, on ships belonging to the Republic of Kazakhstan and sailing on election day), are subject to mandatory clarification as of the day preceding the voting day.
9. The lists of electors for the election of deputies to the Senate of Parliament are compiled by the relevant territorial election commissions on the proposal of the chairman of the relevant regional, city (city of republican significance and the capital of the Republic) maslikhat.
10. Making changes to the lists of voters (electors) after the start of vote counting is prohibited.
