Article 24. Submission of information on the activities of commodity exchanges that constitute a trade secret The Law on Commodity Exchanges
1. Information constituting a trade secret on a commodity exchange is not subject to disclosure, except in the cases specified in paragraphs 2 and 3 of this article.
2. Information constituting a commercial secret may be submitted to a participant in exchange trading in respect of his rights or to his representative on the basis of a power of attorney issued in accordance with the legislation of the Republic of Kazakhstan.
3. Information constituting a trade secret on a commodity exchange must be submitted:
1) bodies of inquiry and preliminary investigation: in criminal cases pending before them with the approval of the prosecutor;
1-1) national security agencies and the State Security Service of the Republic of Kazakhstan with the approval of the prosecutor upon their request to provide information necessary for the prevention, opening and suppression of intelligence and (or) subversive actions;
2) to the courts: in cases pending before them on the basis of a ruling, resolution;
3) to the prosecutor: on the basis of a resolution on the conduct of an inspection within his competence on the material under consideration.;
4) state and private bailiffs: in cases under their jurisdiction, enforcement proceedings are conducted on the basis of a decision of the bailiff, certified by the seal of the judicial authority or the seal of a private bailiff and authorized by the prosecutor;
5) to the authorized body: upon request within its competence;
5-1) state revenue authorities in accordance with the tax legislation of the Republic of Kazakhstan;
6) to the authorized financial monitoring body: for the purposes and in accordance with the procedure provided for by the Law of the Republic of Kazakhstan "On Countering the Legalization (Laundering) of Proceeds from Crime, financing of terrorism and financing the proliferation of weapons of Mass Destruction";
7) to the antimonopoly authority: for the purposes and in accordance with the procedure provided for by the Business Code of the Republic of Kazakhstan, as well as upon request within its competence provided for by this Law.

This Law regulates public relations arising in the course of commodity exchanges and exchange trading, establishes the procedure for regulating and state control over the activities of commodity exchanges in order to ensure their open and effective functioning, protect the rights of participants in exchange trading and fair competition between them.
