Article 248. Environmental requirements for transportation, storage and application of plant protection products, mineral fertilizers and other preparations used in activities, creation of new preparations of the Environmental Code of the Republic of Kazakhstan

1. During transportation, storage and application of plant protection products, mineral fertilizers and other preparations used in activities, the creation of new drugs, individuals and legal entities are required to comply with the rules for transportation, storage and use of these drugs and to take measures to ensure the prevention of disease and death of animals.

2. When creating new drugs, standards for their use in the environment should be developed.

3. In order to prevent the death of animals and the deterioration of their habitat, on the proposal of the authorized state body in the field of protection, reproduction and use of wildlife and (or) the authorized body in the field of fisheries, the authorized body in the field of environmental protection may determine individual territories where the use of pesticides, pesticides and other chemicals is limited or prohibited.

4. It is allowed to use pesticides that are included in the list of pesticides approved by the authorized plant protection body in coordination with the authorized body in the field of environmental protection and the state body in the field of sanitary and epidemiological welfare of the population.

5. Inclusion in the list of pesticides specified in paragraph 4 of this article is allowed after conducting toxicological studies, hygienic regulation of their handling, establishment of hygienic and environmental standards and implementation of state registration of these pesticides.

6. The state registration of pesticides is carried out in accordance with the procedure determined by the authorized plant protection body in coordination with the authorized body in the field of environmental protection and the state body in the field of sanitary and epidemiological welfare of the population.

7. In the presence of potentially dangerous chemical and biological substances in mineral fertilizers and other preparations, the authorized plant protection body, on the recommendation of the authorized state body in the field of protection, reproduction and use of wildlife or the authorized body in the field of environmental protection, conducts toxicological studies, on the basis of which environmental standards for these mineral fertilizers and other preparations are established.

8. Prohibited:

1) extraction of objects of the animal world with the use of explosive devices, pesticides and other chemical preparations, with the exception of the use of pesticides and other chemical preparations in the extermination of field rodents, as well as in cases of mass epizootics, rabies and other animal diseases in coordination with the authorized state body in the field of protection, reproduction and use of wildlife;

2) the use of pesticides, pesticides, mineral fertilizers and other drugs:

in protected areas in specially protected natural areas;

in designated resting areas in places where animals congregate during migration and breeding, as well as in areas of special value as a habitat for wild animals.;

in designated habitats and artificial breeding of rare and endangered species of animals;

3) leave pickled seeds in agricultural and other lands on the surface of the earth that are not embedded in the soil and are available for wild animals to eat.

9. In order to protect fish and other aquatic animals from pollution of their habitat by pesticides, pesticides and other chemical preparations, it is prohibited within two kilometers from the existing shores of fishery reservoirs and (or) sites.:

1) the use of aerial pollination in the control of pests, plant diseases and weeds;

2) construction of warehouses for the storage of pesticides, pesticides, mineral fertilizers and petroleum products, the construction of runways for carrying out aviation chemical works, as well as sites for refueling ground equipment with pesticides, pesticides and baths for bathing sheep.
