Article 25. Social protection of specialists and support staff who handle (perform an auxiliary function in handling) pathogenic biological agents of groups I and (or) II of pathogenicity of the Law on Biological Safety of the Republic of Kazakhstan

1. Specialists and auxiliary personnel of state-owned enterprises and state institutions, as well as legal entities, one hundred percent of the voting shares (participation shares in the authorized capital) of which belong to the national holding, who handle (perform an auxiliary function in handling) pathogenic biological agents of pathogenicity groups I and (or) II, are subject to social protection with taking into account harmful and (or) dangerous working conditions and the risk of acquiring occupational diseases, as well as the specifics provided for by this Law.

2. Specialists and auxiliary personnel of state-owned enterprises and state institutions, as well as legal entities, one hundred percent of the voting shares (participation shares in the authorized capital) of which belong to the national holding, who handle (perform an auxiliary function in handling) pathogenic biological agents of pathogenicity groups I and (or) II, have the right to:

1) remuneration based on the level of biological risks;

2) health protection and working conditions that meet the requirements in the field of biological safety;

3) compensation for damage caused to life and health in the performance of official duties, in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

4) other rights provided for by the legislation of the Republic of Kazakhstan.

3. Remuneration of specialists and support staff of state-owned enterprises and state institutions, as well as legal entities, one hundred percent of the voting shares (shares in the authorized capital) of which belong to the national holding company, who handle (perform an auxiliary function in handling) pathogenic biological agents of groups I and (or) II pathogenicity in the field of sanitary and epidemiological the welfare of the population, in the field of veterinary medicine and science, includes the official salary, allowances and surcharges based on harmful and/or dangerous working conditions and an increased risk of acquiring occupational diseases.

4. When providing basic annual leave to specialists and support staff of state-owned enterprises and government agencies, as well as legal entities, one hundred percent of the voting shares (participation shares in the authorized capital) of which belong to the national holding company that handles (performs an auxiliary function in handling) pathogenic biological agents of pathogenicity groups I and (or) II, A recovery allowance in the amount of at least two official salaries is paid.

5. Specialists and support staff of state-owned enterprises and government agencies, as well as legal entities, one hundred percent of the voting shares (stakes in the authorized capital) of which belong to the national holding company, who handle (perform an auxiliary function in handling) pathogenic biological agents of pathogenicity groups I and (or) II, while performing the tasks of selection and transportation of vectors and carriers of infectious and (or) parasitic diseases (including their waste products), potentially dangerous substances and materials, including those from individual components of the natural environment, in order to detect pathogenic biological agents and their fragments, payments are made provided for employees sent on business trips in accordance with the legislation of the Republic of Kazakhstan.

Persons provided for in part one of this paragraph, when performing field tasks for the selection and investigation of vectors and carriers of infectious and (or) parasitic diseases (including their waste products), potentially dangerous substances and materials, including from individual components of the natural environment, in order to detect pathogenic biological agents and their if it is impossible to submit documents confirming the cost of renting a home, the cost of renting a home is reimbursed in accordance with the norms, established by the legislation of the Republic of Kazakhstan, without supporting documents.

This Law defines the legal basis of state regulation in the field of biological safety of the Republic of Kazakhstan and is aimed at preventing biological threats.
