Article 263. Creation and leadership of a criminal community, as well as participation in it The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1 The creation or leadership of a criminal community, as well as the creation of an association of leaders or other participants of organized groups (criminal organizations) or the coordination of criminal actions of independently operating organized groups (criminal organizations) in order to commit one or more crimes –
are punishable by imprisonment for a term of twelve to fifteen years with confiscation of property.
2 Participation of heads of organized groups, criminal organizations, structural divisions of criminal organizations in the criminal community –
is punishable by imprisonment for a term of eight to twelve years with confiscation of property.
3 Participation in a meeting of leaders and other participants of organized groups and criminal organizations in order to coordinate criminal activities, including through the use of communications, –
is punishable by imprisonment for a term of twelve to twenty years with confiscation of property.
4 The acts provided for in the first or second parts of this Article committed by a person using his official position, –
are punishable by imprisonment for a term of twelve to twenty years with confiscation of property.
5 The acts provided for in the first, second or third parts of this article, committed by a person holding a leading position among the leaders of organized groups (criminal organizations), –
are punishable by imprisonment for a term of fifteen to twenty years or by life imprisonment, with confiscation of property.
