Article 269. Restrictions on the regime of activity in the state protected area in the northern part of the Caspian Sea of the Environmental Code of the Republic of Kazakhstan

Article 269. Restrictions on the regime of activity in the state protected area in the northern part of the Caspian Sea of the Environmental Code of the Republic of Kazakhstan

     1. Within the state protected area in the northern part of the Caspian Sea, on the basis of functional zoning, protected areas with a complete ban on activities are allocated and additional temporary restrictions are imposed on certain types of work in accordance with the Law of the Republic of Kazakhstan "On Specially Protected Natural Territories".

     2. The following usage regime is established in the protected area in the northern part of the Caspian Sea:

     1) in order to ensure the normal spawning course of fish and juvenile stingrays in the sea, construction and geophysical work, well testing and navigation in the estuarine areas of the Ural and Volga rivers within a radius of 50 kilometers from the most seaward point of the Kazakh part of the land delta of the Volga River and the most advanced in the on the seaward side of the point of the land delta of the Ural River, as well as in a 15-kilometer-wide strip from the coastline on January 1, 1994 between the borders of the above-mentioned coastal areas and further east to the Emba River. At the same time, navigation of vessels engaged in fishing and its transportation, exhibition, replacement, removal and inspection of navigation equipment, scientific research work is allowed in coordination with the authorized state body in the field of protection, reproduction and use of wildlife and the authorized body in the field of fisheries.;

     2) during the period specified in subparagraph 1) of this paragraph, the oil production process must be transferred to autonomous provision of equipment, chemical reagents, fuels, lubricants and other materials, and food. All measures must be taken to ensure the accumulation and storage of waste from the oil extraction process for their subsequent export at the end of the prohibition period.;

     3) in order to preserve birds in nesting sites (in reed beds, on sandy coastal spits and islands), construction work and well testing are prohibited during the period specified in subparagraph 1) of this paragraph.;

     4) carrying out work within the time limits other than those specified in subparagraph 1) of this paragraph within the reed beds (natural biological filter) on the land–sea border is regulated by decisions of authorized state bodies in the field of environmental protection and specially protected natural territories, taking into account the season of the year.;

     5) in order to preserve the population of the Caspian seal, operations for the exploration and (or) production of hydrocarbons from October to May should be carried out at a distance of no closer than 1,852 meters (one nautical mile) from their concentration sites. Given the changing rookeries, all possible measures should be taken to identify seal concentrations.;

     6) in order to avoid negative impacts on birds and Caspian seals, it is prohibited to fly air transport over established habitats and breeding grounds at an altitude below one kilometer, except in cases of scientific research and rescue operations with prior notification to authorized state bodies in the field of environmental protection and specially protected natural areas.

     3. In order to ensure the sustainable existence of the ecosystem of the state protected area in the northern part of the Caspian Sea, the construction of drilling rigs, well testing and navigation are maximally limited when designing exploration and production at sea.
