Article 27. Inviolability of judges of the Constitutional Law On the Judicial System and the Status of Judges of the Republic of Kazakhstan
1. A judge may not be detained, detained, house arrest, summon, administrative penalties imposed by court, or brought to criminal responsibility without the consent of the President of the Republic of Kazakhstan based on the opinion of the Supreme Judicial Council, and in the case provided for in subparagraph 3) of Article 55 of the Constitution, without the consent of the Senate of Parliament. Of the Republic of Kazakhstan, except in cases of arrest at the scene of a crime or the commission of a grave or especially grave crime.
2. After registration of the reason for the start of the pre-trial investigation in the Unified Register of Pre-Trial Investigations, the pre-trial investigation may be continued only with the consent of the Prosecutor General of the Republic of Kazakhstan. In cases where a judge is detained at the scene of a crime or the fact of preparation or attempted commission of a grave or especially grave crime has been established, or he has committed a grave or especially grave crime, the pre-trial investigation against him may be continued until the consent of the Prosecutor General of the Republic of Kazakhstan is obtained, but with mandatory notification within 24 hours. Special operational search measures and secret investigative actions against a judge may be carried out in accordance with the procedure provided for by legislative acts of the Republic of Kazakhstan.
Special operational search measures against a judge may be carried out only with the approval of the Prosecutor General of the Republic of Kazakhstan.
3. A judge is issued a certificate in accordance with the procedure established by the Supreme Judicial Council of the Republic of Kazakhstan.
