1. Military representative offices are located in organizations that carry out the execution of the state defense order.

The need to place a military representative office in an organization is determined based on the specifics of the development, production, repair and modernization of weapons, military, automotive and special equipment, technical and special means, the need to ensure high accuracy of instruments and equipment, a sufficient level of reliability of special uniforms, special equipment and personal protective equipment, as well as in the implementation of international treaties and obligations Of the Republic of Kazakhstan.

2. The grounds for the organization and implementation by military missions of quality control and acceptance of military goods (products), dual-use goods (products), military works and military services are contracts for the fulfillment of a state defense order concluded between the authorized body in the field of the state defense order or the recipient of the state defense order and the executor of the state defense order for the supply of military goods (products), dual-use goods (products), performance of military works and provision of military services.

On the basis of these agreements, military missions develop a range of military goods (products), dual-use goods (products), military works and military services subject to control and acceptance by the military mission, which is approved by the authorized body or the recipient of the state defense order.

3. Military missions are assigned the tasks of:

1) participation in the preparation and approval of draft contracts for the implementation of the state defense order;

2) checking the quality and completeness of military goods (products), dual-use goods (products), military works and military services, their compliance with the requirements of technical documentation, tactical and technical specifications (technical specifications, tactical and technical characteristics) and the terms of the contract for the fulfillment of the state defense order;

3) acceptance of military goods (products), dual-use goods (products), military works and military services within the time limits stipulated by the contract for the fulfillment of the state defense order, issuance to the executors of the state defense order of a certificate confirming the quality of military goods (products), dual-use goods (products). (application), military-purpose works and military-purpose services, in accordance with the form approved by the Government of the Republic of Kazakhstan;

4) control over the development of technical documentation, tactical and technical specifications (technical specifications, tactical and technical characteristics) of military goods (products), dual-use goods (products), military works and military services, verification of their compliance with the requirements of national standards, technical documentation, tactical and technical specifications (technical specification, tactical and technical characteristics);

5) keeping records of material assets created or acquired at the expense of budgetary funds within the framework of the execution of the state defense order;

6) monitoring compliance by the executors of the state defense order with national standards for the development and production of military goods (products), dual-use goods (products), performance of military work and provision of military services;

7) participation in the planning and evaluation of measures by the executors of the state defense order for the protection of state secrets carried out during the development, production, repair, modernization, testing and supply of military goods (products), dual-use goods (products), military works and the provision of military services;

8) verification and coordination of the actual costs related to the development and production of military goods (products), dual-use goods (products), military works and services for military purposes both directly and through cooperation in accordance with the rules of pricing for military goods (products), dual-use goods (products), military works, and military services under a state defense order.

4. During quality control and acceptance of military goods (products), dual-use goods (products), military works and military services, military missions are required to:

1) to monitor the quality of production and testing of military goods (products), dual-use goods (products), their assemblies, assemblies and parts, as well as the compliance of components and materials with the requirements of national standards, technical documentation, tactical and technical specifications (technical specifications, tactical and technical characteristics);

2) to monitor the quality of military works and services, conducting tests, as well as their compliance with the requirements of national standards, technical documentation, tactical and technical specifications (technical specifications, tactical and technical characteristics);

3) participate in conducting acceptance tests of military goods (products), dual-use goods (products);

4) participate in conducting periodic, qualification, and type tests of military goods (products) and dual-use goods (products) and issue conclusions based on their results;

5) participate in the analysis of the reliability of military goods (products), dual-use goods (products) based on the results of production, testing and operation;

6) monitor the implementation of decisions on issues related to the quality and reliability of military goods (products), dual-use goods (products), compliance by the executors of the state defense order with the storage conditions of accepted military goods (products), dual-use goods (products) and their maintenance;

7) monitor the metrological support for the production of military goods (products), dual-use goods (products), the performance of military work and the provision of military services, as well as the implementation and compliance with national standards;

8) suspend the acceptance and shipment of military goods (products), dual-use goods (products) in case of non-fulfillment of the terms of the contract for the fulfillment of the state defense order or decisions taken to ensure the quality and reliability of the goods (products), negative results of its tests, the identification of defects during operation that caused the release of failure of the product(s), if these defects are also present in the product(s) in production;

9) suspend the performance of military works and the provision of military services in case of non-fulfillment of the terms of the contract for the fulfillment of a state defense order or decisions taken to ensure the quality and reliability of works and services.

5. It is prohibited to issue a certificate or other document on the final acceptance of military goods (products), dual-use goods (products) that are not finished in production, not completed, without conducting prescribed tests and with other inconsistencies with the terms of the contract for the fulfillment of the state defense order.

6. The provisions of this article do not apply to the State Security Service of the Republic of Kazakhstan.

This Law regulates public relations in the field of the defense industry, the state defense order, as well as certain issues of the turnover of weapons and military equipment.
