Article 278. Environmental requirements for shipping of the Environmental Code of the Republic of Kazakhstan
1. It is prohibited to use equipment and equipment, as well as vessels that previously operated in other water basins, without conducting an environmental survey in order to avoid accidental introduction of flora and fauna into the Caspian Sea.
2. All types of movements by water transport should be presented as part of the pre-design and project documentation. At the stage of detailed design and organization of work, the seasonal timetable of ships should be determined and the routes of ships should be indicated on cartographic materials. Hydrometeorological conditions, including ice conditions, as well as periods and places of spawning and migration of valuable fish species, seal rookeries, and bird nesting should be taken into account when choosing travel routes.
3. All vessels must be equipped with closed fuel bunkering systems, containers for collecting polluted waters and household waste, equipped with devices that prevent their discharge into open water bodies.
4. Transportation of bulk materials, chemicals and dangerous goods must be carried out in closed containers and special containers that exclude their release into the environment, in accordance with the requirements of the legislation of the Republic of Kazakhstan on merchant shipping.
5. The hulls of ships, other navigational aids, offshore drilling rigs and platforms must be covered with modern certified anticorrosive materials.
6. Refueling of vessels at sea should be carried out using systems that exclude spills and leaks of fuel and lubricants.
7. Noises and vibrations from ships must not exceed the maximum permissible noise levels established by sanitary and epidemiological rules and regulations, hygienic standards.
8. The construction equipment of special purpose vessels should be equipped with devices to reduce noise and vibration.
9. Double-hulled tankers are used for tanker transportation of hydrocarbons and other dangerous substances in the Caspian Sea.
10. Vessels must be equipped with equipment that prevents contamination of ship decks with petroleum products and the discharge of contaminated wastewater into reservoirs. It is prohibited to discharge oil, pollutants and wastewater containing them, untreated ballast water, food waste, household garbage and all types of plastics from ships into water bodies. Measures to prevent pollution from ships are taken in accordance with the requirements of the legislation of the Republic of Kazakhstan on merchant shipping.
11. The navigation regime is established in coordination with the authorized state body in the field of protection, reproduction and use of wildlife, authorized bodies in the field of fisheries, protection and use of water resources.
