Article 29. Competence of the akim of the region, the city of republican significance, the capital of the Law on Local Government and Self-government in the Republic of Kazakhstan

1. Akim of the region, city of republican significance, capital in accordance with the legislation of the Republic of Kazakhstan:

1) represents the interests of the region, the city of republican significance, the capital in relations with government agencies, organizations and citizens;

1-1) performs regulatory, implementation and (or) control functions that ensure the solution of tasks of local importance within the relevant administrative-territorial unit.;

1-2) ensures the implementation of the state policy of the executive branch in combination with the interests and needs of the development of the relevant territory;

2) has the right to submit to the heads of central executive bodies an idea of the activities of the territorial subdivision of the central state body in terms of its implementation of laws, acts of the President and Government of the Republic of Kazakhstan, acts of akim and akimat of the region. If the territorial subdivision of the central state body fails to eliminate deficiencies in its work regarding the implementation of laws, acts of the President and the Government of the Republic of Kazakhstan, the akim of the region has the right to submit an appropriate opinion to the President and the Government of the Republic of Kazakhstan.;

2-1) excluded by the Law of the Republic of Kazakhstan dated 12/30/2022 No. 177-VII (effective ten calendar days after the date of its first official publication);

3) submits to the President of the Republic of Kazakhstan a proposal on awarding state awards, awarding honorary and other titles to relevant persons;

3-1) submits a submission to the relevant maslikhat for the award of the title of "Honorary Citizen of the region (city)";

4) appoints and dismisses the following officials:

deputy akims of the region, the city of republican significance, the capital in coordination with authorized higher state bodies, the maximum number of which is determined by the Government of the Republic of Kazakhstan.;

heads of executive bodies funded from the regional, city of republican significance, capital of the budget, with the exception of heads who, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, have been granted the right to wear uniforms and are awarded a military or other special rank.;

4-1) Is excluded by the Law of the Republic of Kazakhstan dated 07/11/2022 No. 136-VII (effective sixty calendar days after the date of its first official publication).

4-2) appoints and dismisses the regional Commissioner for children's rights of the region, the city of republican significance, the capital in coordination with the Commissioner for Children's Rights in the Republic of Kazakhstan.;

5) decides on the application of disciplinary measures to the heads of executive bodies funded from the regional, city of republican significance, capital budget, as well as to the akims of districts (cities of regional significance, district in the city of republican significance, district in the capital) in accordance with the legislation of the Republic of Kazakhstan. The procedure for imposing disciplinary penalties on employees of internal affairs bodies funded from local budgets is carried out in accordance with the legislation of the Republic of Kazakhstan.;

6) coordinates the work of district (cities of regional significance, a district in a city of republican significance, a district in the capital) akimats and akims;

7) interacts with local governments through the akims of districts (cities of regional significance, a district in a city of republican significance, a district in the capital);

8) submits for approval by the relevant maslikhats management schemes of an administrative-territorial unit formed on the basis of basic structures of local government approved by the Government of the Republic of Kazakhstan, unless otherwise provided by the laws of the Republic of Kazakhstan;

9) submits the personnel of advisory bodies on interdepartmental issues for approval by the Maslikhat;

11) organizes and ensures the implementation of the legislation of the Republic of Kazakhstan on defense and the Armed Forces, in the areas of territorial defense of the Republic of Kazakhstan, military service by citizens of the Republic of Kazakhstan, in the field of mobilization training and mobilization, as well as on civil protection within its competence;

12) participates in the signing of contracts, as well as in monitoring their execution on an equal basis with the authorized state body of the Republic of Kazakhstan on privatization, lease, sale of enterprises, deposits and other objects of state ownership;

13) exercises control over the activities of subordinate akims.

14) determines the procedure for the sale of products in glass containers at venues for mass sports, entertainment and cultural events;

15) excluded by the Law of the Republic of Kazakhstan dated 02/23/2024 No. 64-VIII (effective sixty calendar days after the date of its first official publication).

16) takes measures to provide material and technical support to state preschool organizations, organizations of primary, basic secondary and general secondary education, including evening (shift) education, organizations of secondary education provided through residential type organizations, technical and vocational, post-secondary and additional education (with the exception of educational organizations in correctional institutions of the penal correction the (penitentiary) system), It also monitors their condition in order to prevent accidents and (or) increase seismic stability.;

17) develops and submits for approval by the Maslikhat a draft plan for the development of education in the relevant territory.

1-1. The akim of the region, the city of republican significance, and the capital on the territory of the relevant administrative-territorial unit sets tasks for the police to prevent offenses, protect public order, and ensure road safety without interfering with operational search and procedural activities, and hears relevant reports from the head of the police department at least once a year.

2. Akim of the region, the city of republican significance, the capital exercises other powers in accordance with the legislation of the Republic of Kazakhstan.

3. The akim of a region, a city of republican significance, or the capital has the right to delegate the exercise of certain of his powers to subordinate akims.

4. The akim of a region, a city of republican significance, or the capital is responsible to the President and the Government of the Republic of Kazakhstan for matters within his competence and for matters within the competence of a regional, city of republican significance, or the capital of the Akimat.

The Law of the Republic of Kazakhstan dated January 23, 2001 No. 148.

This Law, in accordance with the Constitution of the Republic of Kazakhstan, regulates public relations in the field of local government and self-government, defines the competence, organization, and order of activity of local representative and executive bodies, as well as the legal status of deputies of maslikhats.
