1. The right to a selection achievement is protected by the legislation of the Republic of Kazakhstan and is confirmed by a patent. The patent certifies the exclusive right of the patent holder to use the breeding achievement, its priority and the authorship of the breeder.

2. (excluded) 3. Excluded by the Law of the Republic of Kazakhstan dated 06/20/2018 No. 161-VI (effective ten calendar days after the date of its first official publication).

4. The scope of legal protection granted by a patent for a breeding achievement is determined by the set of characteristics included in the description of the variety or breed.

5. The validity period of a patent for plant varieties is 25 years, for animal breeds - 30 years, for grape varieties, ornamental trees, fruit and forest crops, including their rootstocks, is 35 years from the date of filing the application with the expert organization.

The term of validity of a patent may be extended at the request of the patent owner, taking into account the payment made for each year of the extension, but not for more than ten years.
