1. The district (city of regional significance) akimat in accordance with the legislation of the Republic of Kazakhstan:

1) excluded by the Law of the Republic of Kazakhstan dated 04.12.2008 N 97-IV (for the procedure of entry into force, see art. 2);

1-1) ensures the execution of the budget of the district (city of regional significance);

1-2) submits to the relevant maslikhat and the audit commission of the region an annual report on the budget execution of the district (city of regional significance);

1-3) adopt a resolution on the implementation of the decision of the maslikhat of the district (city of regional significance) on the budget of the district (city of regional significance) for the relevant financial year;

1-4) excluded by the Law of the Republic of Kazakhstan dated 07/02/2014 No. 225-V (effective from 01.01.2015); 1-5) excluded by the Law of the Republic of Kazakhstan dated 12/04/2008 No. 97-IV (for the procedure of entry into force, see art. 2);

1-6) forms the budget commission of the district (city of regional significance), approves the regulations on it and determines its composition.

In case of consideration of issues affecting the interests of private business entities, representatives of the National Chamber of Entrepreneurs of the Republic of Kazakhstan are involved in the work of budget commissions in accordance with the legislation of the Republic of Kazakhstan.;

1-7) Approves the regional financial plan of the district (city of regional significance) for the first quarter of the relevant financial year in cases stipulated by the budget legislation of the Republic of Kazakhstan.;

1-8) develops and submits for approval by the Maslikhat a development program for the district (city of regional significance), ensures its implementation;

1-9) ensures the inclusion of energy conservation and energy efficiency measures in the development program of the relevant district, city of regional significance, and also carries out information activities in the field of energy conservation and energy efficiency improvement;

1-10) ensures the implementation of state policy in the field of energy conservation and energy efficiency improvement;

1-11) ensures the inclusion of measures on land development and use in the development program of the relevant territory;

2) manages the district (city of regional significance) communal property in accordance with legislative acts, implements measures to protect it;

This version of subparagraph 2-1) is valid from 01.01.2018 for cities of district significance, villages, towns, rural districts with a population of more than two thousand people in accordance with the Law of the Republic of Kazakhstan dated 11.07.2017 No. 90-VI (current version until 01.01.2020 for cities of district significance, villages, towns, rural districts with a population of two thousand or less (see the archived version of the Law of the Republic of Kazakhstan “On Local Public Administration and Self-Government in the Republic of Kazakhstan” dated 01/23/2011 No. 148 dated 07/11/2017).

2-1) defines the list of district (city of regional significance) communal property transferred to the communal property of a city of regional significance, village, settlement, rural district;

2-2) is excluded by the Law of the Republic of Kazakhstan dated 07/14/2022 No. 141-VII (effective from 07/01/2023).

3) promotes the implementation by citizens and organizations of the norms of the Constitution of the Republic of Kazakhstan, laws, acts of the President and Government of the Republic of Kazakhstan, regulatory legal acts of central and local government bodies;

4) creates conditions for the development of entrepreneurial activity and the investment climate in the territory of the district (city of regional significance);

4-1) organizes exhibition and fair activities;

4-2) determines and approves the locations and (or) routes for the placement of non-stationary retail facilities;

4-3) provides state support measures for social entrepreneurship in accordance with the Entrepreneurial Code of the Republic of Kazakhstan;

4-4) decides on the location of electric charging stations;

IZPI's note! Paragraph 1 is provided to be supplemented by subparagraph 4-4) in accordance with the Law of the Republic of Kazakhstan dated 07/18/2024 No. 126-VIII (effective sixty calendar days after the date of its first official publication).

5) ensures the rational and efficient functioning of the agricultural sector;

6) develops general plans for the development of settlements and villages located on the territory of a given district (city of regional significance), and submits them for approval to the district (city of regional significance) maslikhat, acts as a customer for the construction, reconstruction and repair of objects of district (city of regional significance) communal property and socio-cultural facilities, gives permission for the construction of intra-village (intra-city) and intra-district utility networks and structures, including communication facilities;

7) organizes the construction and operation of water pipes, sewage treatment plants, thermal and electrical networks and other objects of transport and engineering infrastructure, communication networks of the district (city of regional significance);

7-1) provides places with electricity supply for the construction of antenna-mast structures and (or) supports for cellular or satellite communications equipment by cellular or satellite operators upon their application;

7-2) ensures the organization and control of the uninterrupted operation of emergency services systems;

8) ensures the organization of events on military registration and conscription, as well as on civil defense issues;

9) organizes the transportation of passengers in accordance with the legislation of the Republic of Kazakhstan in the field of transport;

10) regulates land relations in accordance with the land legislation of the Republic of Kazakhstan;

11) organizes the construction, operation and maintenance of roads of regional (city of regional significance) significance;

11-1) ensures the installation of special traffic lights with synchronous sound and light signals, road signs and signs, pedestrian crossings equipped with sound and light devices in populated areas, locations of institutions focused on servicing people with disabilities, as well as in the most crowded places.;

 12) organizes the construction of communal housing stock and their provision;

12-1) organizes the preservation of communal housing stock;

12-2) conducts an inventory of the housing stock;

12-3) carries out the seizure, including by way of redemption, of land plots for state needs;

12-4) conducts activities aimed at maintaining the seismic stability of residential buildings located in earthquake-prone regions of the republic;

12-5) organizes the demolition of emergency housing;

12-6) excluded by the Law of the Republic of Kazakhstan dated 07/22/2011 No. 479-IV (effective after ten calendar days after its first official publication);

12-7) provides housing for certain categories of citizens in accordance with the legislative acts of the Republic of Kazakhstan;

12-8) transfers the ownership of citizens' dwellings from the communal housing stock on the terms stipulated by the legislative acts of the Republic of Kazakhstan and in accordance with the procedure determined by the Government of the Republic of Kazakhstan;

12-9) finances and implements measures to improve the sustainability and safety of housing in flood zones, provide life support to the population in possible emergency situations, and build housing for the temporary relocation of the population from flood zones;

13) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

14) resolves issues of social protection of the population, protection of motherhood and childhood, provides targeted assistance to socially vulnerable segments of the population, coordinates the provision of charitable assistance to them and promotes the staffing of rural health organizations;

14-1) ensures the organization and implementation of activities in the penal enforcement sphere in accordance with the Penal Enforcement Code of the Republic of Kazakhstan;

14-2) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

14-3) performs other powers in the field of providing social and other assistance to persons released from institutions of the penitentiary system, as well as those registered with the probation service, in accordance with the legislation of the Republic of Kazakhstan;

14-4) provides housing certificates at the expense of budgetary funds;

15) makes proposals on declaring protected monuments of nature, history and culture located on the territory of a district (city of regional significance) natural and other objects of ecological, historical, cultural or scientific value.;

16) solves the issues of landscaping and exterior design of public places;

16-1) ensures that, at the expense of the local budget, a state technical survey of functioning multi-apartment residential buildings (with the determination of the common property of the condominium object), as well as the preparation and reimbursement of expenses for the production of a cadastral passport of a real estate object for an apartment building and an adjacent land plot in case of receipt of an appropriate request from the owners of apartments, non-residential premises of an apartment building for based on the decision of the apartment owners' meeting, non-residential premises of an apartment building in accordance with the requirements of the Laws of the Republic of Kazakhstan "On Housing Relations" and "On State Registration of rights to Immovable Property";

16-2) has the right, subject to the availability of funds from the local budget, to organize and finance measures for the reconstruction, maintenance or overhaul of the exterior walls and roofs of apartment buildings aimed at giving a unified architectural appearance to the settlement.;

16-3) has the right, if there are funds from the local budget, to organize and finance capital repairs of multi-apartment residential buildings, subject to ensuring the repayment of funds by the owners of apartments, non-residential premises of multi-apartment residential buildings;

16-4) has the right, if there are funds from the local budget, to organize and finance the repair and replacement of elevators in multi-apartment residential buildings, subject to ensuring the repayment of funds by the owners of apartments, non-residential premises of multi-apartment residential buildings;

16-5) develops and approves rules for the organization and conduct of measures for the reconstruction, maintenance or overhaul of exterior walls, roofs of apartment buildings, aimed at giving a unified architectural appearance to the settlement, as well as rules for ensuring the repayment of money by owners of apartments, non-residential premises associated with the repair and replacement of elevators, major repairs of apartment buildings;

17) form consultative and advisory bodies on interdepartmental issues with the involvement of representatives of the National Chamber of Entrepreneurs of the Republic of Kazakhstan on issues affecting the interests of private business entities, in accordance with the legislation of the Republic of Kazakhstan;

17-1), within its competence, provides electronic services using information systems in accordance with the legislation of the Republic of Kazakhstan on informatization;

17-2) carries out organizational work on the creation of territorial councils of local self-government and develops regulations on territorial councils of local self-government;

18) organizes veterinary measures in the relevant territory, the construction and maintenance of special storage facilities (burial grounds) used in animal husbandry, and also organizes the sanitary slaughter of sick animals;

19) excluded by the Law of the Republic of Kazakhstan dated December 27, 2019 No. 291-VI (effective from 01.01.2021);

19-1) provides training for participants in the electoral process;

20) creates state institutions and state-owned enterprises in accordance with the procedure established by the legislation of the Republic of Kazakhstan, sets a staff limit for executive bodies funded from the district (city of regional significance) budget within the staff limit set by the regional executive body and the standards established by the Government of the Republic of Kazakhstan;

21) coordinates the decisions of the state revenue body at the place of registration of the taxpayer on changing the deadlines for fulfilling the tax obligation to pay taxes received in full to the district (city of regional significance) budget;

22) carries out licensing in cases and in accordance with the procedure established by the legislation of the Republic of Kazakhstan on permits and notifications;

23) organizes activities for the prevention of terrorism and extremism, as well as minimizing and (or) eliminating the consequences of terrorism in the territory of a district or city of regional significance through anti-terrorist commissions;

23-1) participates in the prevention of social emergencies, as well as the minimization and (or) elimination of their consequences in the territory of the district, city of regional significance;

24) develops rules for the provision of social assistance, setting the size and determining the list of certain categories of needy citizens on the basis of standard rules approved by the Government of the Republic of Kazakhstan.

25) organizes work on the development of physical culture and sports;

26) creates organizations to provide assistance in accordance with the Law of the Republic of Kazakhstan "On the Prevention of domestic Violence";

27) monitors social tension and risks of labor conflicts;

27-1) creates an infrastructure for sports activities for individuals, including taking into account accessibility for low-mobility groups of the population, at the place of residence and in places of mass recreation;

27-2) carries out state control over the safe operation of attractions and equipment for children's playgrounds;

27-3) carries out state control over the safe operation of sports equipment intended for mass sports;

28) provides housing for champions and prize-winners of the Olympic, Paralympic and Deaflympic Games in accordance with the Law of the Republic of Kazakhstan "On Physical Culture and Sport";

29) organizes the separate collection of municipal waste;

30) organizes the work of the housing inspectorate for the implementation of state control over subjects of control within the boundaries of settlements at social infrastructure facilities in the areas of housing management, gas and gas supply;

30-1) organizes the work of the housing inspectorate for the implementation of state control and supervision over subjects of control and supervision within the boundaries of settlements at social infrastructure facilities in the field of industrial safety for compliance with the requirements of safe operation of hazardous technical devices;

30-2) issues an opinion in the cases provided for in paragraphs 3, 5 and 6 of Article 29 of the Law of the Republic of Kazakhstan "On Trademarks, Service Marks, Geographical Indications and Names of places of origin of Goods";

31) develops and submits for approval to the relevant maslikhat the rates of the tourist fee for foreigners. The rates of the tourist fee for foreigners are developed on the basis of the rules for the payment of the tourist fee for foreigners, approved by the central executive body performing the functions of public administration in the field of tourism activities.

33) monitors compliance with the terms of the agreement on the organization of burial proceedings in accordance with the rules of burial and the organization of grave care.

34) ensures cooperation with non-governmental organizations, individuals and legal entities on socio-economic support for persons (families) in difficult situations;

35) organizes measures to identify and organize support for persons (families) in difficult situations and to ensure employment of the population;

36) develops territorial programs and action plans for socio-economic support for persons (families) in difficult situations and other assistance in accordance with the legislation of the Republic of Kazakhstan;

37) develops indicators of the effectiveness of early detection and organization of support for persons (families) in difficult situations;

38) participates in the development and implementation of the main directions of providing comprehensive support to persons (families) in difficult life situations, in accordance with the legislation of the Republic of Kazakhstan;

39) creates and (or) organizes the activities of family support centers in districts and districts in cities under local executive bodies for social protection and employment of the population;

40) creates and (or) organizes mobile groups for early detection and organization of support for persons (families) in difficult situations, with the participation of subjects for early detection and organization of support (education, health, internal affairs) under the coordination of local executive bodies for social protection and employment;

41) assesses the effectiveness of entities in early detection and organization of support (education, health, internal affairs) to persons (families) in difficult situations and other assistance in accordance with the legislation of the Republic of Kazakhstan;

42) identifies and maintains records, collects, analyzes the causes, and systematically monitors statistical data of individuals (families) in difficult situations.

1-1. The Akimat of the district (city of regional significance) holds a discussion of the draft budget of the district (city of regional significance) at a meeting of the public council established in accordance with the Law of the Republic of Kazakhstan "On Public Councils".

The Akimat of the district (city of regional significance) holds a discussion of the annual budget performance report of the district (city of regional significance) at a meeting of the public council established in accordance with the Law of the Republic of Kazakhstan "On Public Councils".

1-2. The akimat of a district (city of regional significance) prepares and submits to the akimat of the region a list of villages, towns, and rural districts in which employers plan to build rental housing, as well as subsidizes employers' costs for the construction of rental housing in a village, settlement, or rural district.

2. The akimat of a district or city of regional significance exercises other powers assigned to it by the legislation of the Republic of Kazakhstan in the interests of local government.

3. The district (city of regional significance) akimat is responsible for the implementation of the functions assigned to it before the district (city of regional significance) maslikhat.

4. The powers assigned by this article to the district (cities of regional significance) akimats in the city of republican significance (capital) are carried out by the city akimats.

The Law of the Republic of Kazakhstan dated January 23, 2001 No. 148.

This Law, in accordance with the Constitution of the Republic of Kazakhstan, regulates public relations in the field of local government and self-government, defines the competence, organization, and order of activity of local representative and executive bodies, as well as the legal status of deputies of maslikhats.
