1. The license and/or the appendix to the license are subject to renewal in the following cases::

1) changes in the surname, first name, patronymic (if any) of the individual licensee;

2) re-registration of the individual entrepreneur-licensee, change of his name or legal address;

3) reorganization of the legal entity-licensee in accordance with the procedure defined in Article 34 of this Law;

4) changes in the name and (or) location of the licensor's legal entity, a branch of a foreign licensor's legal entity whose business is the provision of financial services (if the address is indicated in the license);

5) alienation by the licensee of a license issued in the class of "permits issued for objects", together with the object in favor of third parties in cases where the alienability of a specific license is provided for in Appendix 1 to this Law.;

6) changing the address of the location of the object without physically moving it for a license issued under the class "permits issued for objects" or for appendices to the license indicating the objects;

7) the existence of a requirement for renewal in the laws of the Republic of Kazakhstan.

The actions of subitems 2), 4) and 6) of part one of this paragraph do not apply to cases when changes in the legal address of the individual entrepreneur-licensee, the address of the location of the legal entity-licensee, the address of the location of the facility for a license issued under the class "permits issued for facilities", or for appendices to the license with The changes in the name of localities and street names occurred in accordance with the requirements of the Law of the Republic of Kazakhstan "On the Administrative-Territorial Structure of the Republic of Kazakhstan". Such changes to the licensees' address and the license object are carried out through the integration of government digital systems.

The submission of applications for license renewal in the cases provided for in subitems 1) and 2) of Part one of this paragraph is not required for renewal through a proactive service in accordance with the Law of the Republic of Kazakhstan "On State and Socially Responsible Services".

The day of applying for a license renewal through a proactive service is considered to be the day of receiving consent to provide this service.

2. In case of a change in the name of the type and (or) subspecies of activity for which the licensing procedure has been introduced, the licensee has the right to submit an application for renewal of the license and (or) the appendix to the license.

The licensee who has a license for the type of activity for which the name has been changed has the right to receive an appendix to the license in case of a preliminary renewal of the license.

3. In order to renew the license and/or the application to the license, the applicant submits the following documents:

1) an application in the form approved by the authorized body in the field of permits and notifications, the National Bank of the Republic of Kazakhstan or the authorized body for regulation, control and supervision of the financial market and financial organizations;

2) in cases of license renewal, a document confirming payment of the license fee, with the exception of payment through the digital government payment gateway;

3) copies of documents containing information about the changes that served as the basis for the renewal of the license and (or) the appendix to the license, with the exception of documents from which information is contained in government digital systems;

3-1) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication);

4) other documents, the submission of which is provided for by the laws of the Republic of Kazakhstan.

4. In the cases provided for in paragraph 1 of this Article, the application for renewal of the license and (or) the appendix to the license must be submitted by the applicant within thirty calendar days from the date of the changes that served as the basis for the renewal of the license and (or) the appendix to the license.

In case of renewal of the license on the grounds provided for in subparagraph 7) of paragraph 1 of this Article, the deadline for the applicant to submit an application for renewal of the license is established by the laws of the Republic of Kazakhstan.

When reissuing a license and (or) an appendix to the license, the licensor does not verify the applicant's compliance with the qualification requirements, unless otherwise established by the laws of the Republic of Kazakhstan, with the exception of reissue on the grounds provided for in paragraphs 4 and 5 of Article 34 of this Law.

5. The Licensor refuses to renew the license and (or) the license annex, initiated on the grounds provided for in paragraphs 1), 2), 4), 5), 6) and 7) paragraph 1 of this Article, in case of non-presentation or improper execution of the documents specified in paragraph 3 of this Article.

If the laws of the Republic of Kazakhstan provide for the need to verify the applicant's compliance with the qualification requirements when renewing the license and (or) the license annex, non-compliance with these requirements is also grounds for refusal to renew the license and (or) the license annex.

6. In case of exclusion of one or more banking and other operations from the licensed type of activity, the applicant is obliged to submit an application for renewal of the license with the license attachment within thirty calendar days after the date of entry into force of the relevant regulatory legal act. In the event of a change in the name of the type and (or) subspecies of activity in the financial sector and activities related to the concentration of financial resources, with the exception of activities in the insurance market, if such a change has not led to a change in the nature of the licensed type and (or) subspecies of activity, the applicant must, within thirty calendar days after the date of entry into force of the relevant regulatory submit an application for renewal of the license with the attachment of documents confirming the payment of the license fee.

In case of non-presentation or improper execution of the documents specified in the first part of this paragraph, the licensor refuses to renew the license.

7. The reissued licenses and (or) appendices to the licenses are drawn up in digital form in compliance with the provisions of Article 48 of this Law.

8. Unless another term is established by Article 34 of this Law, the licensor shall renew the license and/or the license annex within three working days from the date of submission of the documents provided for in paragraph 3 of this Article, except for the case specified in subparagraph 7) of the first paragraph of paragraph 1 of this Article, the license and/or appendices to licenses for educational activities are reissued within the time period provided for in paragraph 3-1 of Article 57 of the Law of the Republic of Kazakhstan "On Education".

This Law regulates public relations related to the introduction and implementation of a permissive or notification procedure for the implementation of certain types of activities or actions by private business entities and other persons provided for by this Law.
