1. State inspectors of environmental protection institutions within the boundaries of their territories and protected areas have the right:

1) to check the residence permit of persons located in specially protected natural territories;

2) visit facilities of individuals and legal entities located on the territory of an environmental institution and its protected area in order to carry out state control and supervision over compliance with the requirements of the legislation of the Republic of Kazakhstan;

3) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication);

4) take prompt response measures in the order of state supervision or file lawsuits in court if violations of the legislation of the Republic of Kazakhstan in the field of specially protected natural territories, protection, reproduction and use of wildlife, forest legislation of the Republic of Kazakhstan on the termination or prohibition of the activities of individuals or legal entities in accordance with the laws of the Republic of Kazakhstan in connection with the application of rapid response measures;

5) determine the amount of damage caused as a result of violations of the legislation of the Republic of Kazakhstan in the field of specially protected natural territories, protection, reproduction and use of wildlife, and forest legislation of the Republic of Kazakhstan, and on the basis of this, file claims against the perpetrators for voluntary compensation for this damage or bring a lawsuit to court;

6) draw up acts of state inspectors and send materials to the relevant state bodies for taking measures in cases of violations of the legislation of the Republic of Kazakhstan in the field of specially protected natural territories, protection, reproduction and use of wildlife, forest legislation of the Republic of Kazakhstan;

7) detain persons in a specially protected natural area, its protected area, who have violated the legislation of the Republic of Kazakhstan in the field of specially protected natural areas, protection, reproduction and use of wildlife, the forest legislation of the Republic of Kazakhstan, and deliver them to law enforcement agencies;

8) stop vehicles and floating vehicles in a specially protected natural area, in its protected area, and inspect them;

9) to seize from individuals and legal entities who have violated the legislation of the Republic of Kazakhstan in the field of specially protected natural territories, protection, reproduction and use of wildlife, forest legislation of the Republic of Kazakhstan, firearms, illegally obtained products and tools for their extraction, vehicles and floating means in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

10) for the storage, carrying and use of special equipment and service weapons in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

11) to wear uniforms with insignia (without shoulder straps) in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

12) suspend the activities of individuals and legal entities upon detection of violations of the legislation of the Republic of Kazakhstan in the field of specially protected natural territories, protection, reproduction and use of wildlife, forest legislation of the Republic of Kazakhstan.

2. Actions (inaction) and decisions of state inspectors of environmental institutions may be appealed in accordance with the procedure established by the laws of the Republic of Kazakhstan.

3. State inspectors of environmental institutions, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, are provided with uniforms with insignia (without shoulder straps), special equipment and service weapons.

4. State inspectors of environmental institutions, in accordance with their competence, draw up the following acts::

1) an act based on the results of the audit;

2) protocol on an administrative offense;

3) an order to eliminate violations of the requirements of the legislation of the Republic of Kazakhstan in the field of specially protected natural territories, protection, reproduction and use of wildlife, forest legislation of the Republic of Kazakhstan;

4) Resolution:

on bringing perpetrators to administrative responsibility in case of violation of the legislation of the Republic of Kazakhstan in the field of specially protected natural territories, protection, reproduction and use of wildlife, forest legislation of the Republic of Kazakhstan;

on the seizure of firearms, mining implements, illegally obtained products, transport and floating facilities for temporary storage until a court decision is rendered.

The Law of the Republic of Kazakhstan dated July 7, 2006 No. 175.

This Law regulates public relations on the creation, expansion, protection, restoration, sustainable use and management of specially protected natural territories and objects of the state nature reserve fund, representing special ecological, scientific, historical, cultural and recreational value, as well as being a component of the national, regional and global ecological network.
