Article 34. Notification procedure The Law On the Plant World
1. Notifications in the field of protection, protection, restoration and use of flora shall be sent at least ten working days before the expected date of the activity specified in paragraph 1 of Article 33 of this Law.
Attached to the notification are:
for harvesting wild plants for pharmaceutical, food and technical needs:
1) information containing information about the land plot, the volume and period of harvesting (harvesting) wild plants;
2) the consent of the owner of the land plot or land user to harvest (harvest) wild plants or a title document;
3) materials of the resource survey;
4) a receipt for payment for the use of plant resources in the order of special use of the plant world, except in cases of payment through the payment gateway of the digital government;
for the introduction and/or acclimatization of plants:
1) information containing information about:
the origin of the planting material, seeds and their quantity;
location, volume and timing (period) of planting and sowing plants;
2) quarantine certificate for planting materials, seeds (for domestic transportation);
3) an act of quarantine phytosanitary control and supervision issued by the state plant quarantine inspector (upon import);
4) passport for seeds and (or) passport for planting material;
5) recommendations of the environmental protection and scientific organization for the introduction and (or) acclimatization of plants;
for the export from the territory of the Republic of Kazakhstan and import into the territory of the Republic of Kazakhstan of plant genetic resources in accordance with the obligations under the Nagoya Protocol on Regulation of Access to Genetic Resources and Fair and Equitable Sharing of Benefits from their Application to the Convention on Biological Diversity, to which the Republic of Kazakhstan is a party:
1) a reasoned opinion on access to plant genetic resources issued by the relevant government agency;
2) phytosanitary certificate;
3) National certificate for access to plant genetic resources issued by the national coordination center;
4) an agreement on access to plant genetic resources.
2. The state bodies receiving notifications in the field of protection, protection, restoration and use of flora, within ten working days, are obliged to provide consent or a reasoned refusal to carry out the activities specified in paragraph 1 of Article 33 of this Law, subject to the notification procedure.
If a motivated refusal is submitted by a State body, the activity can be carried out only if the grounds for refusal are eliminated.

This Law regulates public relations and establishes the legal basis of state policy in the field of protection, restoration, and use of flora.
