Article 35. Access to electronic information resources of the Law on Informatization  -Excluded by the Law of the Republic of Kazakhstan January 9, 2026 No. 256-VIII SAM 

     1. The state electronic information resources of the Republic of Kazakhstan are publicly accessible, with the exception of electronic information resources of limited access.

     Government agencies ensure the creation of publicly accessible state electronic information resources in Kazakh and Russian.

     2. The conditions and procedure for access to electronic information resources of limited access are determined by the legislation of the Republic of Kazakhstan and the owner of these resources, including through the conclusion of agreements between the owners of electronic information resources.

     2-1. Access to electronic information resources that are confidential for data analytics is carried out taking into account the depersonalization of electronic information resources. The data is provided to the operator in accordance with the data management requirements.

2-2. Access to electronic information resources that are confidential to the operator of the national artificial intelligence platform is carried out taking into account the depersonalization of electronic information resources. The data is submitted to the operator of the national artificial intelligence platform in accordance with the data management requirements.

     3. The owner of the information system of a state body, who is not the owner of the state electronic information resources contained therein, provides access to these resources on the basis of an agreement concluded by the owner of the electronic information resources with the owners of other state electronic information resources.

     4. Access to electronic information resources is carried out in one of the following ways:

     1) by sending a request to the owner or owner of an information system for access to electronic information resources using e-mail and specifying an identification number, or in the form of an electronic document certified with an electronic digital signature, or by other means established by the owner or owner of electronic information resources;

     2) by direct user access to publicly available electronic information resources, information systems.

     5. Access to government electronic information resources containing:

     1) regulatory legal acts, with the exception of those containing state secrets or other legally protected secrets;

     2) information on emergency situations, natural and man-made disasters, weather, sanitary-epidemiological and other conditions necessary for the life and safety of citizens, settlements and industrial facilities;

     3) official information about the activities of government agencies;

     4) information accumulated in the open information systems of government agencies, libraries, archives and other organizations.

     6. Government agencies, state legal entities, and legal entities with state participation in the authorized capital are required to provide individuals and legal entities with open data in Kazakh and Russian through the open data Internet portal.

     The operator ensures the functioning of open data Internet portals, open budgets, open regulatory legal acts, open dialogue and evaluation of the effectiveness of government agencies in Kazakh and Russian languages.

     7. In case of dissemination of information on telecommunications networks prohibited by a court decision that has entered into force or the laws of the Republic of Kazakhstan, as well as access to which has been temporarily suspended by an order of the Prosecutor General of the Republic of Kazakhstan or his deputies to the authorized body in the field of mass media on the elimination of violations of the law, authorized bodies, owners or owners of Internet resources must Take immediate measures to restrict access to prohibited information.

     This Law regulates public relations in the field of informatization that arise in the territory of the Republic of Kazakhstan between government agencies, individuals and legal entities during the creation, development and operation of informatization facilities, as well as with state support for the development of the information and communication technology industry.
