Article 37. Attorney-client privilege of the Law on Advocacy and Legal Assistance
1. Attorney-client privilege consists of the fact of contacting a lawyer, information about the content of oral and written negotiations with the person requesting assistance and other persons, the nature and results of actions taken in the interests of the person requesting assistance, as well as other information related to the provision of legal assistance.
2. Lawyers, their assistants, interns, employees of the presidium of the bar association, legal advice, law firm, as well as a person in respect of whom the right to practice law has been terminated or suspended, may not disclose, or use in their own interests or the interests of third parties, any information obtained in connection with the provision of legal assistance.
3. A lawyer who discloses information related to attorney-client privilege without the consent of the person requesting assistance is liable in accordance with the law.
4. Submission of information and information to the authorized financial monitoring body in accordance with the Law of the Republic of Kazakhstan "On Countering the Legalization (Laundering) of Proceeds from Crime, financing of terrorism and financing the proliferation of weapons of mass Destruction" does not constitute disclosure of attorney-client privilege.
5. The duty of attorney-client privilege is not limited in time.
6. Lawyers, their assistants, interns, and employees of the presidium of the bar association, legal advice, and law offices are required to take the necessary measures to preserve attorney-client privilege, including its protection from unauthorized access.
