Article 38. Time and place of voting of the Constitutional Law on Elections in the Republic of Kazakhstan

     1. Voting on the election of the President, deputies of the Mazhilis of Parliament and maslikhats, akim, and members of other local self-government bodies is held on election day from seven to twenty o'clock local time. Territorial election commissions, upon the recommendation of the relevant akim, precinct election commissions, have the right to set a different time for the start and end of voting. At the same time, voting may not begin earlier than six o'clock and end later than twenty-two o'clock. The decision of the territorial commissions to change the start and end times of voting must be communicated to the voters.

     2. The precinct election commission notifies voters of the time and place of voting no later than ten days in advance, and when electing members of local self-government bodies other than maslikhats, no later than five days before the voting day through the mass media, as well as by other means.

     3. At polling stations established on ships belonging to the Republic of Kazakhstan and sailing on election day, in military units, remote and hard-to-reach areas, at cattle breeding sites, in rest homes, sanatoriums, inpatient treatment and preventive institutions, pre-trial detention facilities and temporary detention facilities, as well as at representative offices of the Republic of Kazakhstan In foreign countries, the precinct election commission may declare the voting over at any time if all the voters included in the list have voted. The list of such precincts is approved by the relevant election commission no later than seven days in advance, and when electing members of local government bodies other than maslikhats, no later than three days before the election.

     4. Voting on the election of deputies of the Senate is held within one day. In this case, the time of voting is determined by the territorial election commission.
