Article 39. Admission of citizens to military and special educational institutions, as well as expulsion and reinstatement. Conclusion of contracts on military service with citizens studying in military and special educational institutions of the Law on Military Service and the Status of Military Personnel
1. Military and special educational institutions that implement educational programs of higher, technical and vocational education on the basis of general secondary education have the right to enroll:
1) citizens who have not completed military service, who have reached the age of seventeen in the year of admission, but not older than twenty-two years;
2) citizens who have completed military service and military personnel undergoing military service until they reach the age of twenty-four in the year of admission;
3) military personnel undergoing military service under a contract, until they reach the age of twenty-five years.
Admission of citizens to military and special educational institutions is carried out on a competitive basis in accordance with the Rules of admission to military and special educational institutions that implement educational programs of the appropriate level, approved by the authorized body.
When conducting a competition for admission to military educational institutions, the preferential right, subject to successful completion of all stages of competitive selection in accordance with the rules of admission to military educational institutions, implementing educational programs of the appropriate level, have:
citizens who completed pre-conscription training as Zhas Sarbazov, Zhas Aybinov for a period of at least two years;
orphaned children and children left without parental care;
graduates of educational institutions with additional military training programs;
children of military personnel with at least fifteen years of service, as well as persons discharged from military service with a length of service of twenty years or more, with the exception of persons discharged for negative reasons;
persons awarded the "Altyn Belgi" badge;
winners of international Olympiads and contests of scientific projects (scientific competitions) in general education subjects, republican and international competitions of performers and sports competitions of the last three years, awarded with diplomas of the first and third degrees, the list of which is determined by the authorized body in the field of education, winners of the presidential, republican Olympiads and contests of scientific projects in general education subjects of the current year, awarded with diplomas The first – third degrees, provided that their chosen specialty corresponds to the subject of the Olympiad or competition.
Military personnel sent to study at foreign military educational institutions are trained in accordance with international treaties of the Republic of Kazakhstan and contracts on military service, as well as invitations to study.
2. Citizens who have reached the age of fifteen in the year of admission, but not older than seventeen, have the right to enroll in military educational institutions that implement technical and vocational education programs based on basic secondary education.
3. A person may be admitted to reinstatement in a military or special educational institution if less than one year has passed since the date of his discharge, with the exception of persons reinstated on the basis of a positive conclusion of the military medical commission.
4. A person who has been dismissed from military service for negative reasons cannot be reinstated in a military or special educational institution.
5. Graduates of military and special educational institutions that implement educational programs of higher education are awarded the military rank of "lieutenant".
Upon graduation from military educational institutions that implement educational programs for technical and vocational education, military personnel are awarded the military rank of "sergeant".
Cadets of the Military Medical Faculty are awarded the military rank of "Medical service Lieutenant" after completing their undergraduate studies or after completing the fifth year of the educational program of continuous integrated medical education.
Military personnel who continue their studies in military internship programs or in the sixth year of the educational program of continuous integrated medical education, undergo military service in a military position of a variable composition of a military intern.

This Law regulates public relations in the field of military service by citizens of the Republic of Kazakhstan and defines the foundations of the state policy on social security for military personnel.
