Article 39. Issuance and use of the payment card of the Law on Payments and Payment Systems
1. Payment cards are issued on the territory of the Republic of Kazakhstan by payment service providers of the Republic of Kazakhstan who have the right to issue a payment card. The issue and use of payment cards are carried out on the basis of an agreement concluded by the issuer of the payment card with the holder of the payment card.
The issuer of a payment card has the right to issue payment cards jointly with other organizations to provide their holders with payment and other types of services in accordance with the procedure and on the terms of contracts concluded between them.
The method of concluding and the terms of the agreement on the basis of which payment cards are issued and used are established by a regulatory legal act of the National Bank of the Republic of Kazakhstan.

1-1. The National Bank of the Republic of Kazakhstan determines the procedure for issuing payment cards, as well as the requirements for servicing operations involving their use in the territory of the Republic of Kazakhstan.
2. The issuer of a payment card shall notify the National Bank of the Republic of Kazakhstan of the issue of payment cards in accordance with the procedure established by the regulatory legal act of the National Bank of the Republic of Kazakhstan.
3. Before concluding a payment card use agreement with the payment cardholder, the payment card issuer is obliged to inform the payment cardholder about the conditions and security measures when using the payment card, the methods of filing claims and the procedure for their consideration.

5. The issuer of the payment card publishes on its Internet resource information on the types and conditions of issuing payment cards, a standard contract for issuing a payment card, and information on security measures when using the payment card.
6. The issuer of the payment card shall notify the holder of the payment card of the amount of the fee charged for servicing the payment card or the accrual of arrears in case of non-payment, and also ensure that the holder of the payment card receives confirmation of the fact that the holder of the payment card has paid the fee for servicing his payment card in accordance with the procedure stipulated by the agreement between them.

This Law regulates public relations arising in the field of organization and functioning of payment systems, regulation of payment systems and supervision (oversight) of them, regulation of the payment services market and control over it, as well as the implementation of payments and (or) money transfers in the Republic of Kazakhstan.
