Article 39. Voting premises of the Constitutional Law on Elections in the Republic of Kazakhstan

     1. Voting in the elections of the President, deputies of Parliament, maslikhats, akims, and members of other local self-government bodies should be conducted in specially designated premises, in which sufficient booths for secret voting should be equipped, places for issuing ballots should be determined, and ballot boxes should be installed so that the voters must pass through when approaching them. through the booths for secret voting. At the same time, observers, proxies, representatives of the media and members of the election commission should be provided with the opportunity to observe the ballot boxes, the entrance and exit from the booths for secret voting.

     1-1. When equipping a polling station, conditions must be provided for unhindered access of voters who are citizens with disabilities and voting in it.

     2. Persons staying in the polling station are required to strictly observe the rules established by the election commission. The Chairman of the relevant election commission regulates the number of voters who are in the polling station at the same time; he is responsible for the order and has the right to demand that anyone who violates the provisions of this Constitutional Law and interferes with the conduct of voting leave the premises.

     On election day, the presence of unauthorized persons not related to the electoral process in the polling station is prohibited.

     In case of violation of the legislation of the Republic of Kazakhstan on elections, a member of the precinct election commission is immediately suspended from participating in its work, and an observer and other persons are removed from the voting premises upon a reasoned written decision of the election commission.

     The enforcement of this decision is carried out by the internal affairs bodies, which also take measures to bring a suspended member of the election commission, as well as a remote observer or other person to responsibility provided for by the laws of the Republic of Kazakhstan.

     3. The internal affairs bodies are responsible for ensuring order in the voting premises. Employees of the internal affairs bodies should be in the voting room only at the invitation of the chairman of the commission and must leave it immediately after the restoration of order or at the request of the Chairman of the commission.
