Article 4-1. Commission for consideration of issues of registration of real estate Law on the special status of the city of Almaty
1. The Real Estate Registration Commission (hereinafter referred to as the commission) is a collegial body under the local executive body that considers issues of registration of rights to immovable property built by a person on a land plot owned by him on the right of ownership or land use, without obtaining appropriate permits in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
2. The territories and facilities to be reviewed by the commission are approved by the local representative body of the city of Almaty.
The territories specified in the first part of this paragraph may not include land plots that, in accordance with the legislation of the Republic of Kazakhstan, cannot be granted ownership or land use to individuals and (or) non-governmental legal entities for construction purposes.
3. The deputy akim in charge of land issues is appointed Chairman of the commission.
The composition of the commission is formed from among the deputies of the local representative body of Almaty, representatives of state bodies and organizations, members of the Public Council of Almaty and other persons.
4. The Commission issues an opinion on the registration of rights to immovable property located in the territory of the city of Almaty, the rights to which are not registered.
When preparing an opinion, the commission considers issues of compliance or non-compliance of the immovable property specified in part one of this paragraph with architectural, urban planning, construction, environmental and other requirements established by the legislation of the Republic of Kazakhstan.
Information on the work of the commission is posted quarterly on the Internet resource of the executive body of the city of Almaty.
5. The commission's opinion is signed by all members of the commission and is advisory in nature.
If a member of the commission has a special opinion, the conclusion is not signed by him, and the special opinion is submitted in writing to the chairman of the commission.
6. The executive body of the city of Almaty, based on the positive conclusion of the commission, decides on the registration of rights to immovable property.

This Law establishes the legal framework that defines the special status of the city of Almaty, based on its characteristics as a scientific, cultural, historical, financial and industrial center, guarantees for its further development by establishing measures of financial, economic and social incentives.
