Authorized body:

1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

1-1) formulates and implements state policy in the field of commodity exchanges;

2) develops and approves regulatory legal acts in the field of regulating the activities of commodity exchanges, commodity exchange clearing centers, brokers, dealers;

2-1) develops and approves the rules of exchange trading in coordination with interested government agencies;

2-2) develops and approves the list of exchange-traded goods, makes changes and (or) additions to it in coordination with the interested state bodies.;

2-3) develops and approves a list of socially significant exchange-traded goods, makes changes and (or) additions to it in coordination with interested government agencies.;

3) excluded by the Law of the Republic of Kazakhstan dated January 13, 2014 No. 159-V (effective ten calendar days after the date of its first official publication);

3-1) excluded by the Law of the Republic of Kazakhstan dated December 29, 2014 No. 269-V (effective from 01.01.2015);

3-2) develops and approves mandatory requirements for the electronic trading system of commodity exchanges;

3-3) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication);

 3-4) develops and approves the rules for the formation and use of guarantee and insurance funds; - Excluded by the Law of the Republic of Kazakhstan.

3-5) develops and approves qualification requirements and a list of documents confirming compliance with them for the activities of commodity exchanges, brokers and clearing centers of commodity exchanges;

3-6) develops and approves requirements for the hardware and software complex of the commodity exchange clearing center;

3-7) analyzes and monitors the activities of commodity exchanges;

4) excluded by the Law of the Republic of Kazakhstan dated January 13, 2014 No. 159-V (effective ten calendar days after the date of its first official publication);

4-1) excluded by the Law of the Republic of Kazakhstan dated 02.01.2021 No. 399-VI (effective after ten calendar days after the date of its first official publication); 5) excluded by the Law of the Republic of Kazakhstan dated 02.01.2021 No. 399-VI (effective after ten calendar days after the date of its first official publication);

5-1) coordinates the rules and standards of self-regulatory organizations;

6) publishes information on the activities of commodity exchanges and exchange trading, with the exception of information constituting a commercial or other secret protected by the law of the Republic of Kazakhstan;

6-1) Is excluded by the Law of the Republic of Kazakhstan dated 12/30/2021 No. 96-VII (effective sixty calendar days after the date of its first official publication).

7) carries out international cooperation in the field of commodity exchanges;

7-1) creates conditions for the development of international exchange trading on the commodity exchange;

8) excluded by the Law of the Republic of Kazakhstan dated 17.07.2009 N 188-IV (for the procedure of entry into force, see art. 2);

9) excluded by the Law of the Republic of Kazakhstan dated January 13, 2014 No. 159-V (effective ten calendar days after the date of its first official publication);

10) excluded by the Law of the Republic of Kazakhstan dated 02.01.2021 No. 399-VI (effective ten calendar days after the date of its first official publication) 10-1) excluded by the Law of the Republic of Kazakhstan dated 02.01.2021 No. 399-VI (effective after ten calendar days after the date of its first official publication)

10-2) maintains a register of self-regulating organizations;

10-3) sets the maximum size of a trading lot in one trading session, with the exception of agricultural products, in cases stipulated by the rules of exchange trading.; - Excluded by the Law of the Republic of Kazakhstan.

10-4) maintains a register of commodity exchanges that organize exchange trading in exchange-traded goods and a register of commodity exchanges that organize exchange trading in non-standardized goods, and also places them on its Internet resource; - Excluded by the Law of the Republic of Kazakhstan.

10-5) maintains a register of market makers, and also places it on its Internet resource;

10-6) sets the maximum amount of entrance fees for members of the commodity exchange, payments for participation in exchange trading and broker commissions;

11) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

This Law regulates public relations arising in the course of commodity exchanges and exchange trading, establishes the procedure for regulating and state control over the activities of commodity exchanges in order to ensure their open and effective functioning, protect the rights of participants in exchange trading and fair competition between them.
