1. The categories of persons subject to probation are determined by the Criminal and Penal Enforcement Codes of the Republic of Kazakhstan, as well as this Law.

2. Persons in respect of whom probation is applied have the right to:

1) contacting and receiving information in their native or other language that they speak about their rights and obligations, the punishment imposed by the court, the procedure and conditions for the execution of other criminal law measures, their changes, as well as the procedure for submitting proposals, statements and complaints;

2) appeal against the actions or omissions of probation subjects in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

3) participation in activities for re-socialization, social adaptation and rehabilitation in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

The persons specified in paragraph 1 of this Article also have other rights provided for by the legislation of the Republic of Kazakhstan.

3. Persons in respect of whom probation is applied are obliged to:

1) comply with and comply with the procedure and conditions of probation control;

2) Excluded by the Law of the Republic of Kazakhstan dated 12/30/2021 No. 95-VII (effective sixty calendar days after the date of its first official publication).

3) comply with the legal requirements of probation entities;

4) provide reliable information to the probation subjects.

The persons referred to in paragraph 1 of this article shall also bear other duties provided for by law.

The Law of the Republic of Kazakhstan dated December 30, 2016 No. 38-VI SAM.

This Law regulates public relations in the field of the organization and functioning of probation and establishes the concept, purpose, objectives, principles, types and forms of probation, as well as the legal status of persons in respect of whom probation is applied and the subjects who carry it out.
