Article 40. Commercialization of the results of scientific and (or) scientific and technical activities of the Law on Science and Technology Policy

1. The state guarantees economic incentives for the development of scientific and (or) scientific and technical activities, the development of public-private partnerships in the field of scientific and (or) scientific and technical activities, financing the commercialization of technologies in priority sectors of the economy in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

2. State scientific organizations, state organizations of higher and (or) postgraduate education are allowed to create, including jointly with other persons, organizations whose activities consist in the practical application (commercialization) of the results of scientific and (or) scientific and technical activities.

3. The disposal of property rights to intellectual property objects of state scientific organizations, state organizations of higher and (or) postgraduate education is carried out by the owner of their property in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

It is allowed to allocate part of the income from the commercialization of the results of scientific and (or) scientific and technical activities carried out (target capital), financing scientific research or its commercialization.

4. The founders of an organization that commercializes the results of scientific and (or) scientific and technical activities shall inform the relevant industry authorized body about its creation no later than seven calendar days from the date of state registration.

5. Subjects of scientific and (or) scientific and technical activities may contribute intellectual property rights to the authorized capital of an organization that commercializes the results of scientific and (or) scientific and technical activities.

6. The assessment of intellectual property rights made as a contribution to the authorized capital of an organization that commercializes the results of scientific and (or) scientific and technical activities is carried out in accordance with the legislation of the Republic of Kazakhstan on evaluation activities.

7. Management of shares (shares of participation) in the authorized capitals of organizations engaged in commercialization of the results of scientific and (or) scientific and technical activities is carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

This Law regulates public relations in the field of science, scientific and (or) scientific and technical activities, commercialization of the results of scientific and (or) scientific and technical activities, defines the basic principles and mechanisms of functioning and development of the national scientific system of the Republic of Kazakhstan.
