Article 41. Enlistment in the reserve of the Law on Military Service and the Status of Military Personnel

Article 41. Enlistment in the reserve of the Law on Military Service and the Status of Military Personnel

   1. Persons who have not reached the age limit for staying in the reserve are considered to be enrolled in the reserve.:

     1) dismissed from military or law enforcement service or from service in civil protection bodies;

     2) dismissed from service in special state bodies of the Republic of Kazakhstan:

     from among the enlisted and non-commissioned personnel;

     from the State Security Service of the Republic of Kazakhstan;

     for negative reasons;

     due to non-fulfillment of the terms of the service contract;

     3) those who have not completed military service due to exemption from conscription;

     4) those who have not completed military service in connection with the granting of deferrals from conscription upon reaching the age of twenty-seven;

     5) women with a military accounting specialty;

     6) trained in the programs of reserve officers and sergeants of the reserve at military departments of organizations of higher and (or) postgraduate education;

     7) those who have completed training in military-technical and other specialties on a paid basis in specialized organizations of the Ministry of Defense.

     2. Persons staying in the reserve shall undergo a medical examination to determine their fitness for military service in accordance with the Rules of military medical examination.

     3. Persons who have been released from conscription and have not completed military service due to the granting of deferrals from conscription upon reaching the age of twenty-seven, as well as citizens who have completed training in military-technical and other specialties in specialized organizations of the Ministry of Defense on a paid basis, are enrolled in the reserve by local military authorities of the district., cities of regional significance with the assignment of the military reserve rank "private" ("sailor").

     4. When enlisting in the reserve, the military accounting specialty is determined by the local military administration bodies of the district (city of regional significance).

     5. The reserve of military personnel for the national security agencies and the authorized body in the field of foreign intelligence shall be established in accordance with the legislation of the Republic of Kazakhstan.

     5-1. Employees dismissed from the State Security Service of the Republic of Kazakhstan are sent to the local military authorities for registration and enlistment in the reserve with the assignment of a military reserve rank equal to their existing special rank.

     6. Staying in the reserve consists in passing military training camps, following the rules of conscription and observing the duties of military registration.

     7. Staying in the active reserve of military personnel of the military intelligence agencies of the Ministry of Defense consists of military service while performing assigned operational tasks within the framework of intelligence activities. The order of stay in the active reserve of military personnel of the military intelligence agencies of the Ministry of Defense is determined by the Minister of Defense of the Republic of Kazakhstan.

     8. When conscripts enrolled in the reserve undergo military training or military service under a contract, they are transferred to the category of conscripts enrolled in the reserve.

 

The Law of the Republic of Kazakhstan dated February 16, 2012 No. 561-IV SAM.

     This Law regulates public relations in the field of military service by citizens of the Republic of Kazakhstan and defines the foundations of the state policy on social security for military personnel.
