Article 42-2. Conducting a written survey of the Housing Relations Act
1. A meeting shall be held by means of a written poll, if the previously announced meeting did not take place in absentia due to the lack of a quorum. The meeting is held on the initiative of the council of the house, the chairman of the association of property owners, a trustee of a simple partnership, or at the request of the audit commission (auditor), or at the initiative of the housing inspectorate, or at the request of at least ten percent of the owners of apartments, non-residential premises.
2. To organize a meeting, an initiative group is determined by conducting a written survey from among the owners of apartments and non-residential premises.
3. A written survey is conducted within a period of no more than two months from the date of the announcement of the meeting.
4. The written survey sheet must contain the serial number, address of an apartment building, questions put to the vote, a place for the signature of the owner of the apartment, non-residential premises, signatures of the members of the council of the house.
5. The written survey sheet is sent on purpose or by e-mail to each owner of an apartment or non-residential premises within seven calendar days from the date of the announcement of the written survey.
The owner of the apartment or non-residential premises in the written survey sheet indicates the surname, first name, patronymic (if it is indicated in the identity document), the number of the apartment, non-residential premises, opinion on the issues put to the vote, and signs the written survey sheet.
6. The House Council or the initiative group collects and accepts written survey sheets on purpose or by e-mail to record and compile a written survey protocol.
7. The voting results are summed up by means of a written survey carried out collectively as part of the members of the house council, an initiative group from among the owners of apartments, non-residential premises, the chairman of the association of property owners or a trustee of a simple partnership, or a representative of the management company, or the manager of an apartment building (if any).
8. The results of voting by means of a written survey shall be recorded in a protocol. The decision shall be deemed to have been taken in accordance with the requirements of paragraph 5 of Article 42-1 of this Law.
The written survey sheets are an integral part of the meeting minutes, stitched and numbered.
