Article 45. Labor relations and responsibility of the head of the educational organization The Law on Education

      1. The labor relations of the employee and the educational organization are regulated by the labor legislation of the Republic of Kazakhstan.  

The recruitment of teachers to work in state preschool organizations, organizations of secondary, technical and vocational, post-secondary and additional education is carried out through a digital object in the field of education, determined by the authorized body in the field of education.

     The positions of teachers and researchers (faculty, researchers) in organizations of higher and (or) postgraduate education are filled on a competitive basis.

     2. The procedure for appointment to positions and working conditions of heads and teaching staff of military and special educational institutions are determined respectively by the national security authorities of the Republic of Kazakhstan, the Ministry of Internal Affairs of the Republic of Kazakhstan, the Ministry of Emergency Situations of the Republic of Kazakhstan, the Prosecutor's Office of the Republic of Kazakhstan and the Ministry of Defense of the Republic of Kazakhstan.

      3. The head of an educational organization, in accordance with the procedure established by the laws of the Republic of Kazakhstan, is responsible for:  

      1) violation of the rights and freedoms of students, pupils, and employees of an educational organization;  

      2) failure to perform functions assigned to its competence;  

      3) violation of the requirements of the state mandatory standard of education;  

      4) the life and health of students, pupils and employees of educational organizations during the educational process;  

     4-1) violation of the standard rules for admission to study in an educational organization or failure to create special conditions for education;

     5) the state of financial and economic activity, including the misuse of material and monetary resources;

     5-1) unreliable and (or) untimely submission of administrative data to informatization facilities in the field of education;

     6) other violations of the requirements stipulated in regulatory legal acts and the terms of the employment contract.

 

 

The Law of the Republic of Kazakhstan dated July 27, 2007 No. 319-III.

This Law regulates public relations in the field of education, defines the basic principles of state policy in this field and is aimed at ensuring the constitutional right of citizens of the Republic of Kazakhstan, as well as foreigners and stateless persons permanently residing in the Republic of Kazakhstan, to education.
