Article 45. Types of preventive control in the field of sanitary and epidemiological welfare of the population without visiting the subject (object) of control and supervision Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan

1. Desk control is carried out on the basis of studying and analyzing information about participants in foreign economic activity, about applicants who applied for testing, confirmation of conformity of products or registration of a declaration of conformity of products, for recognition of the results of conformity assessment, on the results of tests, as well as contained in other documents submitted as evidence of conformity of products submitted to the state the body responsible for the sanitary and epidemiological welfare of the population by the customs authorities, the authorized body in the field of technical regulation.
The objects of desk control are participants in foreign economic activity, conformity assessment bodies, testing laboratories (centers), private business entities declaring product compliance with the requirements of the legislation of the Republic of Kazakhstan.
The list of information required for the implementation of desk control, as well as the procedure for their submission by customs authorities, the authorized body in the field of technical regulation, conformity assessment bodies and testing laboratories (centers) are determined by the state body in the field of sanitary and epidemiological welfare of the population.
Information on participants in foreign economic activity, products imported by them and documents confirming the conformity of imported products are provided by the customs authorities.
Information about applicants who have applied for testing, confirmation of product conformity or registration of a declaration of conformity, for recognition of conformity assessment results, test results, as well as information contained in other documents submitted as evidence of product conformity, shall be provided by the authorized body in the field of technical regulation, conformity assessment bodies and testing laboratories (centers).
The state body in the field of sanitary and epidemiological welfare of the population based on the results of desk control when detecting violations of the requirements of regulatory legal acts in the field of sanitary and epidemiological welfare of the population, hygienic standards and (or) technical regulations, including on the basis of an analysis of the comparison of information between imported products and issued, registered, recognized conformity assessment documents for imported products, in relation to the subjects of desk control, takes the following measures to:
1) participants in foreign economic activity and private business entities declaring the conformity of products with the requirements of the legislation of the Republic of Kazakhstan, engaged in the import and (or) sale of products to the territory of the Republic of Kazakhstan, an order is sent to eliminate violations of the requirements of regulatory legal acts in the field of sanitary and epidemiological welfare of the population with a mandatory explanation of the procedure for its elimination;
2) information indicating violations of the requirements of the legislation of the Republic of Kazakhstan in the field of technical regulation is sent to the authorized body in the field of technical regulation.
2. Monitoring of the results of the sanitary and epidemiological audit is carried out for:
1) information provided on the conducted sanitary and epidemiological audit;
2) submitted audit reports on the compliance of the facility with regulatory legal acts in the field of sanitary and epidemiological welfare of the population.
As part of monitoring the results of the sanitary and epidemiological audit, the completeness of the audit report on the compliance of the facility with regulatory legal acts in the field of sanitary and epidemiological welfare of the population is analyzed.
The results of the sanitary and epidemiological audit are monitored once every six months.
3. Monitoring of the results of production control is based on the transmitted information on the results of production control at epidemiologically significant facilities and on the results of inspections, preventive monitoring with visits.
The entity (facility) maintains internal records, generates and submits periodic reports on the results of production control in accordance with regulatory legal acts in the field of sanitary and epidemiological welfare of the population.
The monitoring of the results of production control is carried out once every six months.
4. Monitoring of notifications is carried out on the basis of an analysis of received notifications from individuals and legal entities that have notified of the beginning and termination of activities in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Permits and Notifications", as well as received appeals from individuals or legal entities, the results of inspections and preventive control.
Notifications are monitored at least once every six months.
5. Sanitary and epidemiological monitoring is a state system for monitoring the health of the population and the environment, their analysis, assessment and forecast, as well as determining the cause-and-effect relationships between the health of the population and the effects of environmental factors.
Analysis, assessment and forecast is a reasonable assessment of the probability of penetration and spread of pathogens or vectors of infectious and parasitic diseases, as well as the negative impact of environmental factors on public health and related potential biomedical and economic consequences.
Sampling in environmental objects (water, soil, atmospheric air) within the framework of sanitary and epidemiological monitoring is carried out at least once a quarter.
