 Article 5. Competence of the authorized body in the field of education

The authorized body in the field of education performs the following powers:

1) performs strategic, regulatory, implementation, and supervisory functions within its competence;

2) on the basis of and in pursuance of the main directions of the internal and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, forms the state policy in the field of education in accordance with the legislation of the Republic of Kazakhstan;

3) ensures the observance of the constitutional rights and freedoms of citizens in the field of education;

4) carries out international cooperation, conducts negotiations with foreign partners and signs, within its competence, international treaties (agreements) and programs in the field of preschool, secondary, technical and vocational, and post-secondary education, establishes rules for the organization of international cooperation carried out by educational organizations, and coordinates this work;

5) carries out coordination and methodological guidance of the activities of local executive bodies in the field of education;

6) provides objective information to society and the state about the state of the system of preschool, secondary, technical and vocational, post-secondary, additional education and the effectiveness of its activities by preparing and publishing an annual national report on the state of development of preschool, secondary, technical and vocational, post-secondary, additional education, as well as publicly available information according to a single list open data of government agencies posted on the Internet portal of open data;

7) carries out quality management of education, methodological and methodological assurance of the quality of educational services provided by educational organizations;

8) carries out educational monitoring and information support of the education management system, approves the rules for the organization and functioning of informatization facilities in the field of preschool, secondary, technical and vocational, post-secondary, additional education, as well as the rules for educational monitoring;

9) directs and coordinates the conduct of educational, methodological and scientific-methodical work, approves the rules for the organization and implementation of educational, methodological and scientific-methodical work in educational organizations, with the exception of educational organizations in the field of culture;

10) defines a legal entity with the absolute participation of the state, which coordinates the conduct of international comparative studies of the quality of education and the preparation of an annual national report on the state of education development, as well as the formation, maintenance, system maintenance, integration and information security of the National Educational Database information system;

11) develops and approves the rules for the formation, maintenance, system maintenance, integration and information security of the National Educational Database information system;

12) develops and approves minimum requirements for informatization facilities in the field of education;

13) develops and approves, together with the authorized body in the field of electronic industry, minimum requirements for computer and interactive equipment for state educational organizations implementing educational programs for primary, basic secondary and general secondary, special, technical and vocational education;

14) develops and approves state mandatory standards for all levels of education, with the exception of higher and postgraduate education;

15) in coordination with the authorized body of the relevant industry, approves the rules for the prevention of bullying (bullying) of a child.;

16) establishes the rules and conditions for the detention of minors in juvenile adaptation centers and support centers for children in need of special social services, in accordance with the laws of the Republic of Kazakhstan;

17) develops and approves the rules for awarding the title of "Best Teacher";

18) determines the dates of the beginning and completion of the academic year, as well as the dates of the intermediate and final certification of students in secondary education organizations;

19) issues a license and (or) an appendix to the license to engage in educational activities for the provision of:

primary education;

basic secondary education;

general secondary education;

technical and vocational education in the specialties included in the register of educational programs for military and special educational institutions by specialty groups;

post-secondary education in the specialties included in the register of educational programs for military and special educational institutions by specialty groups;

spiritual education;

educational and recreational services for minors;

20) develops and approves the requirements for compulsory school uniforms for secondary education organizations;

21) receives notifications on the beginning or termination of activities on preschool education and training and additional education for children;

22) develops and approves criteria for assessing the knowledge of students of secondary, technical and vocational, post-secondary education;

23) maintains the state electronic register of permits and notifications on preschool education and additional education for children;

24) approves the state educational order for secondary education in private educational organizations, the maximum amount of parental tuition fees, as well as the state educational order in republican secondary education organizations;

25) approves the methodology for forecasting the needs of educational organizations implementing pre-school education and training programs, general education curricula for primary, basic secondary and general secondary education, educational programs for technical and vocational education, textbooks and teaching materials;

26) develops and approves rules for providing textbooks and teaching materials to students and pupils of state educational organizations;

27) provides textbooks and educational and methodical complexes to republican organizations of secondary education, as well as compatriots studying in foreign schools in accordance with international treaties;

28) develops and approves a list of international Olympiads in general education subjects, in which the winners, prize-winners and the teachers who prepared them are rewarded with a one-time remuneration from the budget;

29) develops and approves the rules for the payment of one-time remuneration to the winners and prize-winners of international Olympiads in general education subjects, teachers who have prepared them, and also approves the amount of one-time remuneration to the winners and prize-winners of international Olympiads in general education subjects, teachers who have prepared them;

30) develops and approves the rules and criteria for the selection of national and international Olympiads and competitions of scientific projects (scientific competitions) in general education subjects, competitions of performers, competitions of professional skills and sports competitions;

31) approves the list of national and international Olympiads and competitions of scientific projects (scientific competitions) in general education subjects, competitions of performers, competitions of professional skills and sports competitions;

32) approves the list of international Olympiads in general education subjects, international competitions of scientific projects and international competitions of performers, sports competitions in which the winners and prize-winners (awarded with diplomas of the first, second and third degrees) of the last three years are enrolled with the award of an educational grant in educational organizations implementing educational programs of higher education, and the criteria for their selection;

33) develops and approves the rules for organizing and holding the Presidential Olympiad in subjects of the natural and mathematical cycle, republican Olympiads and competitions of scientific projects in general education subjects, republican competitions of performers and competitions of professional skills;

34) develops and approves the rules of training in the form of an external course;

35) develops and approves the rules for the provision of physical culture, recreation and sports facilities assigned to state organizations of secondary education.;

36) develops and approves the rules of operation of the psychological and pedagogical support service in educational organizations;

37) develops and approves a methodology for financing the construction and reconstruction of secondary education facilities at the expense of budgetary funds;

38) develops and approves the rules for awarding and the size of the Orken grant, as well as the methodology for determining its value;

39) develops and approves standard curricula and standard curricula for the levels of preschool education and training, primary, basic secondary and general secondary education;

40) develops and approves standard curricula of a cycle or module of general education disciplines for organizations of technical and vocational education;

41) develops and approves rules for the organization of work on the examination and testing of standard curricula, standard curricula for preschool education and training, primary, basic secondary, and general secondary education;

42) develops and approves rules for the development, testing and implementation of educational programs implemented experimentally in organizations of preschool, secondary, technical and vocational, post-secondary education;

43) develops and approves the rules for maintaining the register of educational programs implemented by organizations of technical and vocational, post-secondary education, as well as the grounds for inclusion in the register of educational programs and exclusion from it;

44) develops and approves a classifier of specialties and qualifications of technical and vocational, post-secondary education in cooperation with interested central executive bodies, employers and other social partners;

45) develops and approves a list of specialties and qualifications for technical and vocational, post-secondary education, which can be obtained in the forms of correspondence, evening training, online training, as well as externships in the fields of culture and art, physical education and sports;

46) develops and approves the rules for issuing permits for studying in the form of an externship in organizations of basic secondary and general secondary education, educational organizations that implement specialized general education and special educational programs, as well as educational programs for technical and vocational, post-secondary education in the fields of culture and art, physical culture and sports;

47) develops and approves the rules for the transfer and restoration of students of technical and vocational, post-secondary education organizations, the rules for granting academic leave to students in organizations of technical and vocational, post-secondary education;

48) develops and approves the rules for placing a state order to provide students of technical and vocational, post-secondary education with places in dormitories and rules for the allocation of places in dormitories of organizations of technical and vocational, post-secondary education;

49) develops and approves the rules for placing a state educational order for the training of personnel with technical and vocational, post-secondary education, taking into account the needs of the labor market, as well as for preschool education and training, secondary education and additional education for children;

50) develops and approves the rules for the organization of academic mobility of students and teachers in organizations of technical and vocational, post-secondary education;

51) develops and approves rules for providing preferential travel by paying compensation to students on the basis of a state educational order in educational organizations that implement educational programs for technical and vocational, post-secondary education, during winter and summer holidays on intercity rail and road transport;

52) creates the republican educational and methodological council of technical and vocational, post-secondary education, educational and methodological associations of technical and vocational, post-secondary education by profile and approves regulations on their activities;

53) develops and approves rules for the organization and conduct of professional practice and rules for defining enterprises (organizations) as practice bases for organizations of technical and vocational, post-secondary education;

54) develops and approves the rules for the organization of dual education in coordination with interested government agencies;

55) develops and approves the types of documents on secondary, technical and vocational, and post-secondary education, the forms of documents on secondary, technical and vocational, and post-secondary education of the state standard and the rules for their registration and issuance, the basic requirements for the content of educational documents of its own sample and the rules for their registration and issuance, as well as the form of a certificate issued to persons who have not completed their education in educational institutions;

56) develops and approves the regulations on the sign "Altyn Belgi";

57) develops and approves the rules for the recognition of documents on secondary, technical and vocational, post-secondary education, which are recognized in the territory of the Republic of Kazakhstan;

58) carries out the procedure of apostillation of official documents originating from organizations of secondary, technical and vocational, post-secondary education;

59) develops and approves the rules for conducting competitions for the award of grants "The best organization of secondary education", "The best organization of technical and vocational, post-secondary education" with the establishment of the amount of grants and the procedure for their award;

60) develops and approves a guaranteed state standard for the network of educational organizations, depending on the population density and remoteness of settlements;

61) conducts state certification of educational organizations, regardless of their forms of ownership and departmental subordination, implementing general educational programs for preschool education and training, primary, basic secondary and general secondary education, educational programs for technical and vocational, and post-secondary education, with the exception of educational organizations implementing educational programs for technical and vocational, and post-secondary education in the field of healthcare;

62) develops and approves criteria for evaluating organizations of preschool, secondary, technical, vocational, and post-secondary education;

63) develops and approves standard rules for admission to educational institutions that implement general education curricula for primary, basic secondary, general secondary education, technical and vocational, and post-secondary education, with the exception of republican, regional, cities of republican significance and the capital of specialized boarding schools-colleges of the Olympic reserve and regional, cities of republican the values and capitals of boarding schools for children gifted in sports;

64) develops and approves standard rules for the ongoing monitoring of academic performance, intermediate and final certification of students for organizations of secondary, technical and vocational, post-secondary education;

65) develops and approves standard curricula and educational programs for children's music schools, children's art schools and children's art schools;

66) develops and approves rules for the organization of children's health and recreation in educational institutions;

67) develops and approves requirements for the structure and content of textbooks for secondary education organizations and educational and methodical complexes for preschool organizations, secondary education organizations, rules for preparation, examination, testing and monitoring, publication of textbooks for secondary education organizations and educational and methodical complexes for preschool organizations, secondary education organizations, rules of choice textbooks and educational and methodical complexes by teachers of state educational organizations, Forms and approves a list of textbooks and basic textbooks on certain subjects for secondary education organizations, educational and methodological complexes for preschool organizations, secondary education organizations, including in electronic form, and coordinates the provision of textbooks and educational and methodological complexes for students and pupils of preschool and secondary education organizations.;

68) develops and approves standard rules for the activities of educational organizations of the appropriate types and types, with the exception of organizations of higher and postgraduate education;

69) develops and approves the rules of operation of psychological support centers;

70) develops and approves standard rules of internal regulations of educational organizations;

71) develops and approves the rules for organizing the educational process for distance learning in organizations of secondary, additional, technical and vocational, and post-secondary education, including in adverse weather conditions, as well as in the event of a state of emergency, restrictive measures, including quarantine, in the relevant administrative-territorial units (at individual facilities), when declaring emergencies and in the form of online training in educational institutions, implementing educational training programs for technical and vocational, post-secondary education, rules for organizing the educational process on credit technology of education, as well as requirements for educational organizations to provide distance learning;

72) develops and approves rules and programs for the assessment of special educational needs;

73) develops and approves the rules for placing a state educational order for special psychological and pedagogical support for children with disabilities;

74) develops and approves the standard of special psychological and pedagogical support for children with disabilities;

75) develops and approves the methodology and rules for per capita regulatory financing of preschool education and training, secondary education, as well as technical and vocational, post-secondary education, taking into account credit technology of education, as well as a list of types and types of organizations of preschool, secondary, technical and vocational, post-secondary education, in which per capita regulatory financing is implemented;

76) in coordination with the authorized bodies of the relevant industry, develops and approves standard qualification characteristics of teacher positions.;

77) develops and approves professional standards for teachers of educational organizations;

78) develops and approves the rules for the rotation of the first heads of state educational organizations;

79) develops and approves, together with the authorized labor body, the rules for the appointment and dismissal of the first heads and teachers of state educational organizations;

80) develops and approves a methodology for rating the effectiveness of teachers and heads of educational organizations;

81) develops and approves the rules for the organization and conduct of advanced training courses for teachers, as well as post-course support for teacher activities, rules for the development, coordination and approval of educational programs for advanced training courses for teachers, the methodology of the voucher-modular system of advanced training, the methodology for determining the cost of advanced training courses for teachers of state educational organizations, as well as educational organizations receiving state educational order, It also organizes retraining and advanced training of teachers.;

82) in coordination with the authorized body of the relevant industry, approves the list of items and substances prohibited for introduction, restricted for use in organizations of preschool, secondary, technical and vocational, post-secondary education, additional education and in their territories.;

83) develops and approves the requirements and rules for the recognition of accreditation bodies, including foreign ones, forms and approves the register of recognized accreditation bodies, accredited educational organizations and educational programs, as well as the grounds for their inclusion in it, suspension and exclusion from it.;

84) develops and approves qualification requirements for the educational activities of educational organizations, with the exception of organizations of higher and postgraduate education, and a list of documents confirming compliance with them;

85) exercises state control over the implementation of the legislation of the Republic of Kazakhstan and regulatory legal acts in the field of preschool, secondary, technical and vocational, post-secondary education, additional education, state mandatory standards of education in educational organizations regardless of their forms of ownership and departmental subordination, educational management bodies, as well as budgetary and financial discipline in subordinate organizations in accordance with with the legislation of the Republic of Kazakhstan;

86) issues binding written instructions on the elimination of identified violations of the legislation of the Republic of Kazakhstan in the field of education within the time limits specified in the instruction;

87) develops and approves rules for the organization of the order, storage, accounting and issuance of forms of state-issued documents on education and their provision to educational organizations implementing general educational programs of basic secondary, general secondary education and educational programs of technical and vocational, post-secondary education, subordinate educational organizations, monitors their use;

88) develops and approves the forms of strict reporting documents used by organizations of secondary, technical and vocational, post-secondary education in educational activities, and approves the list of documents required for teachers of preschool organizations and pre-school classes of secondary schools, lyceums and gymnasiums, organizations of secondary, special, additional, technical and vocational, post-secondary education, and their forms;

89) Approves the forms of a model contract for the provision of educational services for preschool organizations, organizations of secondary, technical and vocational, post-secondary education, a model contract for professional practice and a model contract on dual training for organizations of technical and vocational, post-secondary education;

90) develops and approves the rules for the organization of meals for students in state organizations of secondary, technical and vocational, post-secondary education, extracurricular organizations of additional education, as well as the purchase of goods related to the provision of nutrition to children raised and studying in state preschool organizations, educational organizations for orphans and children left without parental care;

91) approves the rules for the formation of a list of unscrupulous suppliers (potential suppliers) of services and (or) goods for catering students in state organizations of secondary, technical and vocational, post-secondary education, extracurricular organizations of additional education, as well as goods related to the provision of nutrition to children educated and studying in state preschool organizations, educational organizations for orphaned children and children left without parental care;

92) approves the appointment and dismissal of the first heads of educational management bodies of regions, cities of republican significance, the capital, districts (cities of regional significance);

93) develops and approves standards for equipping pre-school, secondary, technical, vocational, post-secondary, and special education organizations with equipment and furniture.;

94) approves the criteria for the reorganization of secondary education organizations established in the organizational and legal form of a state institution into the organizational and legal form of a state enterprise on the right of economic management;

95) approves the sectoral incentive system;

96) develops and approves regulatory legal acts in the field of education in accordance with the purpose and objectives of this Law and the legislation of the Republic of Kazakhstan;

97) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

The powers of the authorized body in the field of education provided for in sub-paragraphs 8), 9), 20), 32), 34), 35), 36), 38), 39), 44), 47), 48), 53), 56), 63), 68), 71), 72), 73), 75), 78), 80), 81), 94) and 95) of the first part of this article do not apply to military and special educational institutions.

The Law of the Republic of Kazakhstan dated July 27, 2007 No. 319-III.

This Law regulates public relations in the field of education, defines the basic principles of state policy in this field and is aimed at ensuring the constitutional right of citizens of the Republic of Kazakhstan, as well as foreigners and stateless persons permanently residing in the Republic of Kazakhstan, to education.
