Authorized body:

1) formulates and implements the state policy in the field of equity participation in housing construction;

2) develops and approves the standard form of the agreement on equity participation in housing construction;

2-1) develops and approves the standard form of the agreement on equity participation in housing construction as part of renovation;

3) develops and approves the standard form of the guarantee agreement;

3-1) develops and approves a standard form of a guarantee agreement within the framework of renovation;

3-2) develops and approves the standard form of the renovation agreement within the framework of the guarantee;

3-3) develops and approves the procedure for the provision by an authorized company of temporary housing and (or) compensation payments to the owners of the renovation facility and (or) real estate included in the renovation facility;

4) develops and approves the rules for accounting by local executive bodies of agreements on equity participation in housing construction and agreements on equity participation in housing construction as part of renovation, as well as agreements on assignment of rights of claims under them;

5) develops and approves the standard form of the land pledge agreement together with the unfinished construction object;

5-1) develops and approves the standard form of the real estate pledge agreement within the framework of renovation;

6) develops and approves the standard form of the pledge agreement for voting shares (participation shares in the authorized capital) of the authorized company;

7) develops and approves a standard form of a trust management agreement for voting shares (shares of participation in the authorized capital) of an authorized company;

8) develops and approves a methodology for determining the amount of the guarantee fee;

9) develops and approves a methodology for determining the capital adequacy ratio;

10) develops and approves a methodology for calculating and forming a reserve for the settlement of warranty cases;

11) develops and approves the rules for issuing permits to attract money from shareholders;

11-1) develops and approves rules for changing the ways of organizing equity participation in housing construction;

11-2) develops and approves the rules for maintaining a unified information system for equity participation in housing construction and equity participation in housing construction as part of renovation;

11-3) provides access to the unified information system of equity participation in housing construction for second-tier banks to comply with the requirements of the Law of the Republic of Kazakhstan "On Payments and Payment Systems"

11-4) develops and approves the procedure for reviewing documents on the construction project of an apartment building or a complex of individual residential buildings for concluding a guarantee agreement and renovation agreements;

11-5) develops and approves the rules for registering the pledge of shares in an apartment building or a complex of individual residential buildings;

11-6) develops and approves standard rules for the formation and maintenance of the register of unscrupulous developers;

12) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated April 7, 2016 No. 486-V SAM.

This Law regulates public relations related to the activities of equity participation in the housing construction of multi-family residential buildings by attracting money from individuals and (or) legal entities, and also establishes guarantees for the protection of the rights and legitimate interests of the parties to the agreement on equity participation in housing construction.
